On Friday, local attorney Michael Acosta was arraigned on the petition for probation violation in his 2020 case.
The case moved from Coutroom 3 to Coutroom 5 because of recusal by the entire Humboldt bench. Acosta filed a demurrer in court and gave a copy to Deputy District Attorney Ian Harris. Mendocino Judge Ann Moorman summarily revoked Acosta's probation. This means the conditions of probation stay in effect, but it stops the clock running on the probation period.
The VOP hearing and the demurrer is scheduled to be heard on 3/7. A demurrer is a legal objection to the sufficiency of a pleading by an opposing party. Until the 3/7 court date, Acosta must abide by all conditions of probation previously imposed.
Acosta has filed an appeal in that case and his conviction has been submitted to the State Bar. I just did a post four days ago and have been regularly reporting on developments in Acosta's 2020 case.
