Another continuance filed in Christie case due to cancer, heart and vascular system health concerns

 


Ray Christie has a trial confirmation hearing scheduled for December 8 for a jury trial currently scheduled for January 17.

Due to cancer and a heart condition, a continuance was previously granted by Judge Gregory Elvine-Kreis.  Defense is asking for another trial continuance due to Christie's cancer and "ongoing additional health concerns involving the functioning of his heart and vascular system."

Larson Law Firm filed five documents today including a declaration from Mr. Rick Richmond and an application for order shortening time. Mr. Richmond will be at the December 8 hearing in person. His associate, Ms. Caroline Glennie-Smith will appear via Zoom.

Mr. Rees was electronically served with the documents this evening. If Mr. Rees choses to comment before the December 8 hearing after reviewing the documents, I will add his comments to the post.

Based on a November 23 conversation with Deputy District Attorney Roger Rees, the declaration states the People are going to object to this request for continuance. At the last hearing, Mr. Rees stated this is a 5 year old case. Of course, the People will object on record. Off record, even the People know the reality. A defendant's health issues and needing to be present for their own trial is good cause. If Judge Elvine-Kreis denies the continuance; if defense and Christie can't adequately prep for this trial; that gives Christie grounds to appeal.

Humboldt Superior Court is short staffed right now, including court clerks. Judge Elvine-Kreis has ongoing hearings in the lawsuit filed against him by Rory Kalin. Christie is out of custody. There isn't a shortage of other jury trials with defendants in custody and cases with time not waived. 





12/8: Motion to continue granted. January dates vacated. Trial setting March 8.
