In September, I did a detailed post on the lawsuit filed by John Doe vs Fortuna Elementary School District. There was a hearing on December 2 and Fortuna Elementary's lawyer was a no show.
On 1/20/23, there is an Order to Show Cause hearing with possible sanctions against Fortuna Elementary's attorney. A Case Management Conference and Trial setting is scheduled for 1/27/23.
The civil lawsuit has allegations of molestation, sexual abuse and harassment by Matthew Oliver Gibson and Principal Mat Bigham.
The lawsuit is John Doe vs Fortuna Elementary School District, Mat Bigham, Matthew Gibson and Toddy Thomas Middle School. On 9/2 there was a dismissal without prejudice against Toddy Thomas Middle School only.
I covered Matthew Oliver Gibson's arrest in 2021. On January 24, 2022, he was convicted in that sex offense case. Gibson took a plea. When I covered that case and the DA filed their complaint, all precautions were taken to protect John Doe's identity in the complaint and coverage.
John Doe was born in 2004. He is now of legal age and an adult not a minor. It is unfortunate that in a new civil lawsuit, his guardian ad litem and current attorney have mentioned the guardian's name all over the paperwork.
1/20/23: Order to show cause discharged after explaination to Court by attorney for Fortuna Elementary and Bigham.
1/27: Another CMC on 4/28.
4/28: 1/9/24 Settlement conference on 1/9/24; Readiness Conference 2/9/24 and Jury trial on 2/13/24.
12/11/23: 1/9/24, 2/9/24 and 2/13/24 dates vacated. CMC on 3/8/24.
Substitution of attorney filed for Bigham on 2/2/24.
3/8/24: CMC continued by stipulation to 6/7/24. Trial assignment scheduled for 2/21/25. Jury trial for 2/24/25.
