Jury to deliberate fate of Cher-ae Heights robbery suspect

 


Closing argument by Ms. Andrea Sullivan and rebuttal by Deputy District Attorney Luke Bernthal concluded this morning in the jury trial for Aubrey Ross. He posted bond and is out of custody. Ross looks very different than his 2016 booking photo.

HCSO Investigator Scott Hicks' mistakes in the investigation of this six year old case about a robbery at Cher-ae Heights Casino ended up being the focus of both attorneys' remarks this morning.

Brief closing instructions were given by Judge Hinrichs after lunch. Ross' fate is now in the hands of the jury. Ross has also worked at Blue Lake Casino.

Ross is charged with one count of PC 211 second degree robbery with a special allegation of PC 12022.53 (b), a gun enhancement which adds 10 years to any prison sentence for certain felonies. The DA alleges a gun was used in the commission of the crime.

Listed below are charges and a proposed disposition on 4/15/22. That plea offer was rejected by retired Judge John Feeney and therefore the case proceeded to trial.


I was the only one in court today and no one other media has done any coverage on the trial. As usual, if you see coverage after this post, regular readers know why.

12/21: After a couple of hours of deliberation on 12/19, courthouse was closed due to the earthquake on 12/20. Juror's resumed deliberations at 1:30 on 12/21.
