Confirmation of an evidentiary hearing for Brian Fiore was continued to August 4. The evidentiary hearing is set for August 10. Twice, Judge Christopher Wilson has said he is not sure if the hearing will proceed on that day. It was continued again to August 6 for confirmation of hearing.
Deputy District Attorney Whitney Timm appeared for Deputy DA Luke Bernthal. She said that Mr. Bernthal had emailed Mr. Russ Clanton about a motion to continue the August 10 hearing.
"Mr. Bernthal is out unexpectedly due to COVID related issues," said Ms. Timm. "There are also discovery issues."
Fiore's attorney is Mr. Clanton. Since Fiore is at High State Desert Prison, his presence has been waived at hearings by Mr. Clanton. He did not waive written notice for the motion to continue.
Mr. Clanton acknowledged he had heard from Mr. Bernthal. It was Mr. Clanton who said that Mr. Bernthal is "in quarantine."
