Credibility matters in court and what you say and how you act is important


Kim Walford-Bergel kept referring to Eric Bergel as her husband during the hearings for her request to get a restraining order against Cornelius Lowenstein. Councilmember Austin Allison referred to her as "a single mother."

Two other people from the community called me after my last post and said she was divorced.

I checked court records on the second floor regarding her divorce case and did a follow up with the court clerk staff where more details on the case are available. The Bergels are divorced. The entry of judgement was on 1/24/19. As of February 2, 2019, the State of California recognized the parties as single.

Whether Kim Walford-Bergel is married or single is  an issue because credibility is important when people testify in court. This is just one observation about one difference in Bergel and Allison's testimony.  What else will we learn when Bergel is cross examined this afternoon and when Lowenstein testifies?

Bergel is expected to testify this afternoon. She has the burden of proof. Anyone can make claims but you have to prove it in court and according to the law.

Regardless of the outcome of this afternoon's hearing, when will Kim Bergel be professional and talk to all media and all her constituents?

Regardless of this situation between her and Lowenstein, Kim Bergel and this Eureka City Council need to listen to all their constituents; not just those who support them and politically agree with them.

Most of this current Eureka Council ignores concerns that are inconvenient to them such as HACHR's divisive and destructive impact on this community or the input on H and I streets.

Will bully Eric Bergel behave outside court today or continue his belligerent behavior? His testimony on the stand did not help his ex wife. Eric Bergel is a hypocrite to complain about harassment against his ex wife while engaging in the same behavior.

There are laws protecting free speech and intimidating anyone, including the press. Eric, you really are not helping your wife's case.

Both parties in this case need to step back and look at their behavior and why they are in a courtroom today.

  1. Eric has a habit of engaging in intimidating behavior, it seems, both in person and online. During Kim's campaign, he began to post threats of physical violence aimed at some of those who spoke out in disagreement with her policies. I reminded him that this was unseemly behavior that could harm his wife's chance at election. He then turned his vitriol on me, after which I took to referring to him as The First Lady, which he wasn't too crazy about. He's a self-absorbed prima donna, at best.
