The defense's own gag order in the Cory Fisher case is now backfiring on them.
While the signature on the gag order is from Deputy Public Defender Brie Bennett, when the motion was granted, Fisher had another attorney; (then) Deputy Conflict Counsel Marek Reavis. He is now the interim Public Defender.
This morning, the defense asked for a motion to continue the preliminary hearing scheduled for April 24. It was granted.
Deputy District Attorney Stacey Eads told Retired Judge Bruce Watson, "The Court will likely grant the continuance for good cause" but she wanted to put the People's objection and reasons for objection on record.
"There have been a number of continuances," she said. "It is not fair to the victims or Mr. Fisher."
Deputy Conflict Counsel, Joe Judge, who recently inherited the case, has already filed a motion to modify the gag order.
Mr. Judge mentioned a memo sent by Sgt. Duane Christensen of the Humboldt County Correctional Facility.
"Investigators from my office are forbidden to interview anyone in jail," said Mr. Judge. "The gag orders are not supposed to impede defense investigation!"
Fisher is now finding out what it is like to be a defendant in the criminal justice system.
He ultimately answered "yes" in exasperation and entered a time waiver.
Not before he told Retired Judge Bruce Watson," I don't want to waive time. I am not stupid. I know it isn't his fault. I have had six different attorneys. He tells me he is going to here. I don't know what to believe anymore. AmI going to have this attorney in 30 days? If I had private counsel, I'd be done by now."
Intervention is scheduled for May 8. Preliminary hearing is scheduled for May 24.
