Judge Carter denies both the 995 motion and the motion to supress in the Kade Chandler case


Both defense motions filed in the Kade Chandler case were denied by Visiting Judge Marjorie Carter.
The hearing this morning lasted two hours, with CHP Officer Garth Gundersen testifying as well as arguments presented by the defense and the People. Judge Carter explained her decisions before ruling on each motion.

The arguments by the People and the defense on implied consent, warrants, blood draw procedures were educational and informative. The testimony and transcripts could be crucial in future.

A defense witness was not allowed to testify because he discussed court testimony with someone else present in the courtroom during break. The defense witness was expected to testify after the break. Witnesses had been excluded from the courtroom prior to testifying.

The jury trial is scheduled for October 16.

Chandler had a 995 motion and a motion to supress by the defense originally scheduled for September 20. The hearing  for those two motions got continued to September 27; then continued again to today at 9:15 in Courtroom 2 to be heard by Visiting Judge Marjorie Carter.

The original incident occurred in February 2015 on Hwy 36. Chandler was 20 years old at that time. It resulted in the death of Savannah Kindred and Kendra Lewis and injury to Bradley Theumler.

Chandler is charged with Count 1 gross vehicular manslaughter. Count 2 gross vehicular manslaughter while intoxicated and special allegation of great bodily injury.

Deputy District Attorney Roger Rees is prosecuting the case. Mr. Manny Daskal and Mr. Benjamin Okin are representing Chandler.
