Defense in Richard Haberman's case wants recordings, warrants




Preliminary hearing was continued for Richard Haberman on August 5.  Haberman was arrested in connection with the same investigation that led to the arrest of local attorney, Michael Acosta.

Today, Deputy Public Defender Wade Orbelian asked for a setting of the preliminary hearing. He also plans to file a motion to compel that would be heard on the same day.

Mr. Orbelian told Visiting Judge Marjorie Carter, ", Hopefully, I can informally resolve discovery issues."

Deputy District Attorney Candace Myers appeared on the case for the People. She is not the assigned prosecutor for the case.

Mr. Orbelian and Ms. Myers had a discussion about discovery issues. "The audio recording was discovered on March 29." Mr. Orbelian mentioned recordings and warrants.

"That is not standard," said Ms. Myers. "I will put in a special request."

Haberman is out of custody and he has waived time. Haberman wants to be personally present for his preliminary hearing.

At the last court date, Mr. Orbelian said Haberman is a caregiver for his wife who is undergoing chemotherapy and this puts him in a "high risk" group affected by COVID 19. There is "ongoing discovery" which includes search warrants and affadavits.

Setting of preliminary hearing is scheduled for August 31. If Mr. Orbelian files his motion to compel discovery, it will be heard on that date.
