Judge Wilson says excellent trial arguments by both attorneys; however will review preliminary transcript to rule on 995 in homicide and attempted murder case


A 995 motion to dismiss some of the charges in Maxx Robison's 2016 case was scheduled this morning at 10:15 in Courtroom 5.

Agreeing with the People that the Judge needs to decide om the 995 motion based on preliminary findings; not what would be presented at jury trial;  Judge Christopher Wilson will review the preliminary transcript; ruling continued until August 24 at 10:15.


A preliminary was scheduled this morning for Robison's 2017 case for alleged possession of drugs in jail but the District Attorney indicated they would ask for a continuance due to witness unavailibility.
Judge Wilson denied the People's request to continue; saying good cause was not shown; the matter was dismissed. DA has to refile.

Deputy DA Carolyn Schaffer elaborated on what she said last week about witness unavailability. The correctional deputy was in Santa Rosa visiting a sick family member. She also said that the correctional deputy told her he needed more time to check on items mentioned in his report that "were different from his recollection." As reported last week, the correctional deputy informed Deputy DA Schaffer of this in the morning, before court.

On that 2017 case, today was the 10th day, defense did not enter time waiver. While Robison was released from custody on this case; he remains in jail for the 2016 case in which he is charged with the murder of Rhianna McKenzie and attempted murder of Elisha Mansell.

    1. You are right though LOCO didn't consistently follow this case, as they don't many others.

Lol, LOCO was in court but I am also covering the Kirby case which was in court today; (hadn't followed it for a while because there was nothing significant) That is not a case other media will follow. Trying to find out arraignment of Conte Watson, which is why I have held off on typing details of the attorney's 995 arguments in the Robison case. The ruling isn't until August 24, so that post can wait. KIEM was there today despite having to cover multiple stories, as well.

    1. I disagree with you about RHBB. Replace it with North Coast Journal and I agree. The rest of the local media does their best, given staffing and other challenges.
