Uber claimed Domenico struck him three times; after he contacted 911, he looked towards his home and " smoke begin to rise"

On August 18, HCSO Deputy Travis Rogers was dispatched to the Manila area for a "reported assault."

When he arrived at the homeless encampment, he saw a wooden structure, approximately 25 feet in length and 10 feet wide, completely engulfed in flames and smoke.

Deputy Rogers explained why first responders thought there may have been children in that wooden structure. A woman with a van parked on 255 had been living in that structure but she was contacted and told law enforcement she had moved out.

Deputy Rogers went to St. Joe's and spoke with Uber  in the ER. "Mr. Uber had a large gash on the upper left side of his head that was bleeding . It was approxinately three inches in length."

Uber told Deputy Rogers that Domenico had struck him in the head with a large stick. Uber said he was inside when he heard someone iutside yell "faggot". Uber exited the residence, confronted Domenico and told him to stop yelling. Uber went back inside, Domenico yelled " faggot" again. Uber came out and saw Domenico holding a stick in "a threatening manner." Uber said he picked up a stick to defend himself and Domenico struck him in the head. Uber dropped to the ground and claimed Domenico struck him twice, once on the side if his head and once on the shoulder. Uber said that the tree branch Domenico struck him with was three feet in length. Deputies were unable to locate that branch.

After he was struck, Uber said he ran from the encampment to a residence across the highway and asked to call 911. After he had contacted 911, he looked over towards his house and saw "smoke begin to rise."

Uber told Deputy Rogers that on August 16, he had been involved in an argument with Domenico and that Domenico "threatened to burn his house down."

During cross examination, Deputy Rogers told Mr. Marek Reavis, that he was familiar with Uber from his contact as a correctional deputy and as HCSO deputy. Uber had told Deputy Rogers that after he was attacked, he heard gunshots.

In response to Mr. Reavis' questions, Deputy Rogers said no firearms were located on August 18; no lighter or fuel was located.

"Two propane tanks were found outside the structure."
