PG & E gate crasher held to answer on all counts; Count 4 modified from original complaint


PG & E Gate Crasher Katherine Zacevich's preliminary is scheduled for this morning.

The People have made an offer in this case;  which are from her arrest in August. Zacevich has another case trailing this one. She was arrested in July for that case.

Arraignment on information on September 5 at 8:30


Count 4 modified to violation of VC 14601.5 (a)  based on Zacevich's refusal to submit to a chemical test when arrested for an alleged DUI in July.

While Judge Dale Reinholtsen granted a holding order for Count 1 as a felony; he agreed with defense argument about it being reduced to a misdemeanor and said that the People had set things up for a 995 a motion.

Deputy Conflict Counsel Mr. David Lee, who represents Zacevich, argued that the People had not provided a breakdown detailing how much of the the cost was due to damage to the gate and  how much was towards security expenses until the gate was fixed. Security had to be provided for 24 hours.

Charges for this  preliminary hearing are:  Count 1, Vandalism; charged as a.felony.  propertyThe complaint states Zacevich "unlawfully and maliciously defaced with graffitti" property belonging to PG and E, with damage over $400.

Count 2, a misdemeanor, is Battery on an officer or emergency personnel;  HCSO Sgt. Greg Allen.

Count 3, a misdemeanor is Resist or Obstruct or Delay of Peace Officer or Emergency Medical Technician; HCSO Sgt. Greg Allen.

Count 4, a misdemeanor, Driving when privilege suspended or revoked for prior DUI.

Charges for the July case are: Count 1
DUI with a special allegation of refusing to take a chemical test. 

Deputy DA Brent Kling is prosecuting the case. Deputy Conflict Counsel David Lee is representing Zacevich.

  1. Isn't there a 2nd DUI charge for her latest incident with law enforcement at the PG&E plant gate?

    1. She has two cases. This preliminary was for her August arrest. The other case was for a July arrest.
