Dear Mr. Stunich,
The report arrived in our Office today and we filed two misdemeanor charges: Penal Code sections 25850 and 171b.
You will be notified by letter of the court date. This case can be dealt with in “early resolution court,” meaning you can choose to plead at arraignment. The offer as indicated on the complaint is to plead to either count.

"I have not received the notice yet so I hope it is a slow plea offer. Otherwise, I am just going to ask for a jury trial and present my case to my fellow citizens and see what happens. I cannot blame Maggie F. as she has a job to do and must do as she sees fit. Hard to believe though that simply forgetting a gun in a bag is cause to become a criminal. I could see if I tried to sneak it in, but simply forgetting about it. I think it shows how anti-gun California has become as I even qualified for a concealed carry permit. In other words, I was investigated and determined to be someone that could be trusted with a gun - a process I voluntarily submitted to. So I guess I am signing that song all day by Mike Curb, "breaking rocks in the hot sun I fought the law and the law won."

"I wanted to let you all know you may see my name in social media or on the news so I wanted to give you the full story. I made a mistake at the courthouse Tuesday. I unknowingly came to the metal detector screening device with a small 32 caliber hand gun in an exterior pocket of a briefcase (I have a concealed carry permit). I put the hand gun there while traveling to San Diego last week in my car as I often get tired and pull over to nap in remote places or at rest stops. I use the bag to carry a laptop when I travel for work so I can more easily review and respond to emails. Unfortunately, I forgot the gun was in the bag as it was in a small, separate compartment so I did not see it when I loaded the bag with files for court Tuesday morning. I assure you I never intended to bring the gun with me. I have already been informed that I will not get the gun back which cost several hundred dollars and I am getting raked over the coals in the local social media. I assure you all that I will never use my work bag to carry a firearm again to make sure this never happens again. I deeply apologize for the incident. I have been a lawyer for nineteen years and have never had a disciplinary incident for any type of misconduct by the state bar nor have I ever acted improperly in court.
Do not worry about me. I suspect that if I am charged it would be with a misdemeanor and usually when someone has no criminal record a slow plea is agreed to wherein if not in any trouble for six months to a year the charge is dismissed. The D.A. may not charge me under the circumstances as the involved deputies made it clear I was cooperative and apologetic and put in their report that I stated it was an accident. I would not file charges if I was D.A., but we will see what happens."

All guns should be banned period. That would save many innocent lives.

DeleteOh good lord Mr. Stunich, quit whining. This isn't a gun control issue its a colossial OOPS on your end. You damn well should know in the last oh....50 years that you don't bring guns to court. You didn't even have the right paperwork for the particular firearm. Just admit you screwed up, don't make a fool of yourself on social media, pay your upcoming fine and move on. ~TMOB
