Third District Supervisor Mike Wilson was correct today when he said every citizen takes on the liability when rules are broken and the County ignores non compliance with the code.
"Git er done" Rex Bohn blew this off and made the latest Schneider permit issue an exemption. Rex doesn't care because the money for County lawsuits or potential liability does not come out of his pockets.
Bohn says there have only been a few complaints. Rex, fear of retaliation and being blacklisted discourages complaints. People see what happens when they speak up.
Why doesn't Rex provide the total cost of litigation, attorney fees and settlement costs and the number of pending litigation against the County at the next Board of Supervisor meeting? That information should then be verified by other local media if they have the guts to file PRAs and spend time on actual news and investigating information that the public deserves to know. I have been writing about the cost and these issues for years.
Rex whined about the former Auditor Controller and what she allegedly cost the County. Let's put the numbers and compare what Rex's "leadership" and decisions have cost the County.
Despite being warned numerous times, since 2010 the County has ignored and then been sued, lost those lawsuits and who paid the price? How much did just the Magney lawsuit and HumCPR lawsuits cost the County? That is not even the tip of the iceberg. How much did the poor decisions about former County Counsel and Public Defender cost the County?
Yesterday there were two cases on calendar. No proof of service is filed yet and no date scheduled in a new 2022 writ of mandate. Mercer Fraser is suing the County of Humboldt.
The other case is Mercer Fraser suing T. Schneider Enterprises, Inc. who is a cross complainant and the case is for breach of warranty. Schneider is represented by local attorney Dustin Owens. Mercer Fraser by Mr Chris McCandless. Trial dates were set for next summer.
11/17/23 update: In the Mercer Fraser vs T. Schneider Enterprises, Inc. case, there was a case management conference. Dates for 6/7/23, 8/4/23 and 8/8/23 were vacated. Settlement conference on 4/9/24; Readiness conference on 6/14/24 and court trial on 6/17/24.
Cher-ae Heights and Schneider's Pacific Affiliates are suing each other. There is a readiness conference in that case this week and we will see if the jury trial scheduled for next week or just drag on as it has for years.
Mercer Fraser and Travis Schneider have a lot of cases in Humboldt Superior Court. I was the one mentioned that Schneider's wife, whose maiden name is Bode, is related to Humboldt Superior Court Judge Joyce Hinrichs. Bode Construction and Bode Property Management is typical "Humboldt way of doing business."
Other recent media coverage brought up that Alan Bongio is related to Schneider's wife .
Owens has represented Schneider when he sued the City of Eureka and now the County. Owens has represented Schneider in other court cases.
Other media coverage mentioned Owens was cced in an email Schneider sent to Rex regarding the permit for his home on Walker Point Road that Rex thinks is no big deal.
Mercer Fraser is one of the frequent businesses Bohn fawns over all the time on his Facebook page.
The good ole Humboldt boys are all married or related to other good ole boys and that is the way power is maintained to keep others from ever moving beyond survival. The good ole boys who get many City of Eureka contracts and special treatment from the County have no issue suing the City and County for meaningless writ of mandates that are more posturing than lawsuits with substance and none of this litigation benefits the public.
The good ole boys do it because they have money to throw away. They do it because they have relatives and friends on Planning Commissions and others who grovel because they are in the "Humboldt Connected Network". They do it because they have Rex defending them and putting a spin at BOS meetings. How many of you who are average Joe or Jane have had Rex advocate for you against the County system and fines?
All of the good ole boys have so much play money to throw on lawyers while the rest of Humboldt struggles. These good ole boys put dummies and sycophants in charge all over Humboldt. These poor decisions impact and keep others stuck and struggling and drain our hard earned money. Generational brats who never had to earn anything and had businesses handed over to them in a corrupt, rural entrenched County. Even mistake after mistake leaves them with play money.
Most of the housing is owned by the same developers, ranchers, property owners who all have their hands in related industries like insurance, construction, title companies and we wonder why people are homeless because decisions on who to house or evict are retaliatory and petty. Only in Humboldt can people get sued for breach of contract, blatant violations and still be in business raking in the money. How many homes does Schneider need in Humboldt and has anyone checked where else he has homes? Ask him if he owns a home and property in Colorado. The system is beyond broken when you can own three or four homes, ignore rules others need to follow while most in Humboldt can't even afford a studio or one bedroom because the system is made to work for certain people by the Bohns and Bongios.
Most people and businesses are just trying to survive and the challenges of the last few years have drained every ounce of energy. Even in the ivory tower where Rex, Virginia, Bushnell, the Bongios, the Schneider's live; that reality is obvious. They just don't care.
Properties and decades old businesses for sale. Empty storefronts. Every industry taxed to death. And Rex has the nerve to be dismissive about County liability?
