I reported on the negotiated plea for Alan Ashmore on March 3, 2020.
The prosecutor for the case is Lake County District Attorney Susan Krones. Ashmore is represented by Ms. Andrea Sullivan who has the contract for public defender clients in Lake County.
In my March 3 post, Ms. Sullivan said the plea deal will theoretically allow him to be paroled after 25 years because he is an elderly offender. If Ashmore had gone to trial and lost, he would’ve been sentenced to life without possibility of parole.
“I am happy that we were able to resolve this without a jury trial," said Ms. Sullivan. "I think that this is the best outcome for all parties involved because they do not have to relive the trauma of that day.”
In their coverage of the sentencing Lake County News reported that in an October 2017 shooting, Ashmore killed his elderly father and a friend, shot and injured a California Highway Patrol officer and another woman and set wildland fires as he tried to flee from authorities.
Ashmore pleaded no contest to first-degree murder for the killing of his 85-year-old father, Douglas Ashmore, as well as the killing of his friend, Richard Braden, the attempted first-degree murder of CHP Officer Steven Patrick, while also admitting to the personal discharge of a firearm that resulted in death and great bodily injury for all three of those charges.
In exchange for those pleas, the District Attorney’s Office dismissed another 18 counts that included assault with a deadly weapon, felon in possession of guns and ammunition, and hit and run. The charges were dismissed with a Harvey waiver.
A Harvey waiver allows a Judge to consider dismissed charges for sentencing.

As Ashmore went to a nearby gas station, where he stole a soda, and then a convenience store, where he took cigarettes and a lighter, Ashmore fired his weapon at one of the clerks, and missed, and threatened another with his gun, authorities said.
He later threatened another man in an attempt to steal his vehicle, though the driver sped off before he was hurt, Anderson said. Ashmore also lit two fires on the side of the road at one point, apparently to distract pursuing officers while he drove from place to place, finally surrendering when he hit a law enforcement roadblock on High Valley Road on the north side of Clear Lake.
The Press Democrat reported on the preliminary hearing.
Alan Ashmore, was at home in in October 2017 and the incident started when a 22-year-old woman refused his advances, according to Lake County District Attorney Don Anderson.
Alan Ashmore held the woman at knifepoint. She fought back and he shot her in the foot before she escaped.
When Ashmore tried to chase after her, his father, Douglas Ashmore, 81, intervened and Alan Ashmore shot him in the face, killing him instantly.
A neighbor who witnessed the shooting, Harold Noell was shot at by Alan Ashmore but Alan Ashmore’s pistol misfired and Noell managed to get away from him.
After retrieving a 12-gauge shotgun from his house, Alan Ashmore then fired into three neighboring houses before driving a short distance and encountering another man, Richard Braden, who was shot and killed in his car.
One responding CHP officer, Steven Patrick was also shot but survived because of his bulletproof vest.
