"My office is in the evacuation zone and majority of his file is in my office. I cannot obtain the file without getting a misdemeanor conviction."


A defense motion to continue Chad Smith's jury trial was scheduled for this morning.  That motion was granted. The jury trial for August 6 was vacated. Trial setting is scheduled for August 16 at 1:30.



Ms. Sullivan told Judge Dale Reinholtsen that in addition to the reasons stated in her motion, "my office is in the evacuation zone and majority of his file is in my office. I cannot obtain the file without getting a misdemeanor conviction."

Deputy District Attorney Stacey Eads did put an objection on record on behalf of the victim. She said given the reasons stated by Ms. Sullivan, "I submit" on the defense motion.

Judge Reinholtsen found good cause and granted the motion. Smith is entitled to have his attorney prepare an adequate defense.

As indicated previously on July 18
by Smith's attorney, Ms. Andrea Sullivan, if the funding requests were granted, she would file a motion for continuance. Ms. Sullivan filed the PC 1050 motion  on July 26.

Judge Reinholtsen was supposed to issue a written ruling on the defense motion to dismiss Counts 1 and 2. He said once he saw the motion to continue, he had another priority matter but the ruling should be done by this weekend and filed by early next week.

Amy Smith, mother of Jane Doe, Smith's stepdaughter has been at every recent court hearing.
