"Mr. Costa, I don't want you to say another word; not to Mr. Kamada; not to me and not to the bailiff."

 


Joseph Costa was arrested by Eureka Police Department on May 21 for PC 273.5 (a) corporal injury to a spouse/cohabitant. The local security guard was arraigned this afternoon.

Costa interrupted Judge Kelly Neel three times in court today. Before that he was loud and disrupted another arraignment. 

Costa was all chatty in court before his case was called. The he piped up when Judge Neel was asking Deputy District Attorney Steven Steward if the alleged victim, Jane Doe was present. "She was going to show up..." 

At this point, Judge Neel explained to him that she was asking the People that question and that he should talk to his attorney. The second time was when Judge Neel ordered him released from custody and was saying he had to have no contact with Jane Doe. Costa apparently thought he got to dictate terms of his release and expressed displeasure.

A competent defense attorney would control his client and explain to the defendant why he should not be speaking in court where everything is being written down. Kamada just stood there. If Judge Neel had not asked Kamada questions before making a decision about Costa's custodial status, he would still be cooling his heels in jail.

While his custodial status was being discussed, Costa burst out and said, "I am going to lose my job." Judge Neel asked if he had a place to stay where Jane Doe was not present. That option would be Costa's mother in Blue Lake.

Mr. Steward was the one that told Judge Neel that the only record Costa had was a conviction from March 2000 for "415, disturbing the peace."

The last time was after Judge Neel was going over the protective order served on him in court.

"Mr. Costa, I don't want you to say another word; not to Mr. Kamada; not to me and not to the bailiff," said Judge Neel.

Trial confirmation is on 6/7; jury trial 6/13.
