Besides going for the jugular in cross examining a child, Russ Clanton believes sex only involves the genitalia of a man and woman


Mr. Clanton started his cross examination of Jane Doe #2 by asking her if she remembered telling the CAST interviewer "she had told a few lies."

Jane Doe #2 said, "yes." She said she remembered saying, "lying depends on the situation."

Mr. Clanton asked Jane Doe about her stepbrother (Melissa, Alexander's ex is his mom), her brother (Julianna is his mom). He brought up Donny G, her biological dad, her paternal grandparents Leonora and Vernon Webb and then asked her about an older cousin, first name initial K and older male cousin, first name initial L.

"Did you ever talk to Jane Doe #1 about sex," said Mr. Clanton.

"Uh, yes," said Jane Doe #2.

"What did you talk about?" asked Mr. Clanton.

"We mentioned we did not know what that was; we heard the word; we wondered what it meant," said Jane Doe #2.

Mr. Clanton: "Did you ever learn about sex from your cousins?"

Jane Doe #2: "No, but I would walk down the hallway and hear my cousin (K) talk about it."

Jane Doe #2 said she did not remember telling CAST interviewer about finding her cousins in the closet with their pants down.

Mr. Clanton showed her a transcript of the CAST interview. Jane Doe #2 read the selected portion and said, "I don't remember saying that." Mr. Clanton then read the statement.

"I remember hide and seek. I don't remember them in the closet and having their pants down."

Mr. Clanton: "Do you remember telling the interviewer that your cousins explained what sex is?" Again, he showed her the transcript.

Jane Doe #2 read it and said, "I am confused. It says mom and dad. I don't know which dad."

Again, Mr. Clanton read the transcript."They taught me and I started doing it."

Jane Doe #2: "I don't remember."

Mr. Clanton: "Do you know what sex is?"

Jane Doe #2: "I do know. It can be fun for adults or it can be for reproducing children."

Mr. Clanton then said it involves "the genitalia of a man and a woman."

Again, he asked Jane Doe #2 what her cousins were doing?

"I don't remember," said Jane Doe #2.

"All those things I asked you; you don't have the answers to thst either," snarked Mr. Clanton.

Then he asked Jane Doe #2 if she told Jane Doe #1 what she had learned from her cousin.

"I don't remember," said Jane Doe #2.

Mr. Clanton: "Did Jane Doe #1 tell you what she knew about sex?"

"I don't remember " said Jane Doe #2.

Mr. Clanton asked if Jane Doe #1 told her about "popping the girl part."

"Oh yeah, I remember that," said Jane Doe #2.

"What did she say it was?" asked Mr. Clanton.

"I remember her telling something about crossing her legs and squeezing like you do gymnastics," said Jane Doe #2.

Mr. Clanton:  "Do you remember telling the interviewer that she did it in front of you and that you tried the same thing?

"No," said Jane Doe #2.

Again, Mr. Clanton showed the CAST transcript to Jane Doe #2.

When the courtroom opened, Deputy District Attorney Stacey Eads said she wanted to make a record that while waiting for the elevators, a female juror commented on Ms. Eads' shoes and looking at the stress ball that Jane Doe #2 was holding, she said, "that is something my granddaughter had." Ms. Eads said she told Jane Doe #2, "lets take the stairs." Mr. Clanton said his concern was the juror was equating her grandaughtervto the witness.

Judge Wilson said the comments were innocuous and an admonishment to the jurors was enough.

Mr. Clanton resumed his cross examination of Jane Doe #2.

Mr. Clanton: "Did Jane Doe #1 tell you that your stepdad had touched her vagina?"
After looking at the transcript, Jane Doe #2 said yes Jane Doe #1 told her and yes she said this to the CAST interviewer.

Mr. Clanton: "Your stepbrother (name withheld) did you spend anytime alone with him

Jane Doe #2 answered, "yes."

Mr. Clanton: "In that time alone, did you have any physical relationship that was sexual?"

"Yes," said Jane Doe #2.

Mr. Clanton asked what they did. Ms. Eads objected. The attorneys met privately with Judge Christopher Wilson for 20 minutes. When the courtroom reopened, jurors were excused and asked to return  Monday.
