Jessica Springer texts Rachel Goldberg: "You are one stupid lying piece of shit" and a naked pic of Rachel Goldberg's chest


At 6:51 a.m. there was a text from Tim Smith's phone to  Rachel Goldberg's phone.
That message contained a picture "of a nude woman woman, of her torso.

The text: "You are one stupid lying piece of shit."

From 6:52 to 6:56, calls were made between Tim Smith, Jessica Springer and Rachel Goldberg's phone. There was a call from Rachel Goldberg's phone to Tim Smith's phone that lasted two minutes.

According to previous testimony Jessica Springer had Tim Smith's phone and Jon Goldberg had Rachel Goldberg's phone that day. Holland said there is no recording to know who made that call.

Between 7:11 and 7:19, twice calls made  from Tim Smith's phone to Jessica's phone.

At 7:56 a.m. there was a text message to Rachel Goldberg's phone. According to previous testimony, this was from Jessica Springer to Jon Goldberg.

"My son does not want me going out there. He knows what happens,when I fucking snap."

Between 7:58 -7:59, there were series of texts and phone calls between Rachel Goldberg's phone and Jessica Smith's phone.

One of those messages, "I will come see you. This is Jon. I am on my way."

Another message from Jessica Springer, "Jon, I am so embarassed."

Then a text message in which Jessica Springer says she kicked Tim Smith out. In that message, she says, "Unless you want to punch him in the face, then I will help you find him. You are a really good man."

Between 8:19 a.m. and 10:41 a.m., there were a series of calls between Jessica Springer's phone and Tim Smith's phone.
They lasted from a "few seconds to 8 1/2 minutes."

There were  more phone calls and text messages between Jessica Springer and Tim Smith's phone between 10:52 and 11:18 a.m.

"Come home, where are you?"

"So sorry for the mess I put you in."

At 12:03, there is a call from Rachel Goldberg's phone to Tim Smith's phone. Holland said the call "doesn't go through."

At 12:40, "Jessica's phone calls 911."

On cross examination, Deputy District Attorney Luke Bernthal questioned Holland about three texts. First, we had to wait two minutes or more for Deputy District Attorney Bernthal to find three texts. All three texts were from Rachel Goldberg were to her "mom". That is how the phone was labeled on the DA's report.

One of those texts (People's item #1099) was, "“Make it clear to the motel clerk clerk that you are fleeing from domestic violence and they are not to give your info to anyone."

The other two text messages were about returning the school van.

Rachel Goldberg to "mom" (People's item #1130):
"Thanks, now I have the school wanting the van back by the night."

"Mom" to Rachel Goldberg (People's item #1132):
"Oh well, tell them Jon has the keys and won't let you have them."

 Then Mr. Bernthal asked Holland why these texts were not included. The defense had already  made it clear on direct, then again on cross that Deputy Public Defender Casey Russo had told Holland what phones to focus on. The prosecution did not present all texts in their report with DA Investigator Perrone.

Does Mr. Bernthal think it is the defense's job to prove claims in his case? No one so far except Rachel Goldberg's friend Frieda Smith has testified about any domestic violence between the Goldbergs. The texts are from Rachel Goldberg but the prosecution has not provided any other evidence that any conversation regarding domestic violence was mentioned by Rachel Goldberg to her mother or anyone before September 26.

 Rachel Goldberg was subpoenaed by the prosecution for a preliminary hearing in which she was the alleged victim. She refused to testify.
