"I seen a body underneath the pickup because I could see under the truck."


Benton Chadbourne is a part of a crew with SJL construction. They subcontract with PG and E.



He testified about what he heard and saw on September 26 but admitted his vision was obscured.

Chadbourne saw "flashes of something" hitting the dirt" but his vision was obscured by "the red pick up truck."

Chadbourne said he heard five gunshots. "There was one then rapid after that."

Chadbourne said that the doors to the red truck were open. He said he ran over to assist Tim Smith after Goldberg fled the scene. At this time, he said Jessica Springer and Tim Smith Jr, were standing on the front porch. Jessica Springer, according to him had not approached Tim Smith, yet.

Chadbourne was on his lunch break talking to his wife "around 10:30/11" when he heard gunshots.

Describing Jon Goldberg fleeing from the alleged crime scene, Chadbourne said, "He flipped a bitch and headed south."

His testimony was going really well until cross examination.

When his answer during cross did not line up with the time the shooting  occurred, his lunch break went from an hour to longer. It went to "two or three hours."

Besides impeaching himself with his own answer,  Chadbourne got defensive and when called out on his inconsistencies and changing testimony by Mr. Russo, he snapped and said, "It has been a year and a half."

Chadbourne admitted that a photo taken of him standing on Rohnerville Road near the crime scene was only taken a month ago  by the DA's office. Some statements he made in court today, he did not tell Officer Brian Taylor in his original statement. Of course, FPD has no recording of original statements.

Chadbourne's cross examination continued after lunch break.  He was still on the stand at 2 p.m.

I am not going to cover what will basically be the same testimony by the construction crew and PG and E workers.

What they could see or could not see due to their vision being obscured or what they thought they heard from across the street does not matter.

None of these people are going to testify that they saw Jon Goldberg shoot Tim Smith.

  1. All the witnesses should have required to stop,sit down, and write down what happened the day Smith was murdered. Then date it, sign it and give it to the FPD as evidence. Why didn't that happen????????
