Motion to release juror information, possible new trial and another attorney for Demetrius Coleman


Sentencing scheduled for convicted murderer Demetrius Coleman on January 7 was vacated this morning by Judge Kelly Neel.

Ms. Andrea Sullivan had filed a motion to release juror information. Today, she declared a conflict today and said she cannot represent Coleman. She remains Coleman's attorney for now. 

Mr. Zachary Curtis has been appointed as an interim attorney for the limited purposes to explore with Coleman whether a new motion for trial should be filed. Mr. Curtis will be handling the motion for release of juror information. This is assuming Mr. Curtis accepts the appointment and has no conflict.

 Coleman has requested a Marsden hearing alleging ineffective counsel. Judge Kelly Neel was ready to have that hearing today but Coleman wanted to "collect his thoughts." 

The clerk did not send notice to jurors. Deputy District Attorney Carolyn Schaffer did not have a copy of the motion for release of juror information.

Next court date is December 30. The Marsden hearing will take place first. Setting for the date for the hearing on the motion for release of juror information, whether a new motion for new trial is needed and future date for sentencing will be addressed at that court date.

On November 10, a jury found Coleman guilty Coleman was found guilty of first degree murder. Special allegations for Count 1;  PC 12022.53 (d) intentional discharge of a firearm and second special allegation is PC 190.2(a) (21) murder was intentional and perpetrated by means of discharging a firearm from a motor vehicle were found true. Victim was Johnny Renfro.
