GOP sues Mike Pence asking he be given sole authority over electoral votes

Vice President Mike Pence is being sued by Republican Representative Louie Gohmert of Texas and several other Republicans including Kelli Ward,  chairs of the Arizona Republican Party and former Arizona state senator.

According to the group's lawyers, Pence refused to be a part of this effort to overturn the election results.

The lawsuit filed in in U.S. District Court for the Eastern District of Texas asks Federal Judge Jeremy Kernodle, a Trump appointed Judge, to declare that Pence has the "exclusive authority and sole discretion" to decide which electoral votes from a given state should be counted.

The lawsuit alleges that part of the 1887 Electoral Count Act should be declared unconstitutional as it violates the 12th Amendment. There is a request for an expedited declaratory judgment.
