Court trial or jury trial? When will it proceed?

 


At trial assignment for convicted human trafficker David Anderson, the discussion about court trial or bench trial came up. And decisions about that went back and forth for several minutes.

After all that, when the trial will start will not be known until Monday. That is the day the jury trial is scheduled to start. With this case, whether that decision will happen on January 4 is not guaranteed. With Anderson, there is always some issue; some last minute twist.

Mr. Michael Acosta, Anderson's attorney, told Judge Christopher Wilson, "No resolution at this point. We made an offer it was rejected."

Anderson prefers a court trial and is willing to waive time. Ms. Fleming said "if we know who the trial is assigned to, we would waive trial by jury."

Judge Wilson said if it is a court trial, it would be assigned to Judge John Feeney.

Deputy District Attorney Stacey Eads is on vacation and DA Maggie Fleming  tried to reach her but was unable to despite a few attempts . 

On Monday, if the People agree to a jury trial and a courtroom is available, the trial will start that day. If not, Anderson has not entered a time waiver and the trial will be reset before January 28.
