After saying they had no witnesses today, as we were getting ready to conclude for the day, the prosecution said they had one witness.
This is after the defense had to present witnesses out of order and the prosecution has still not rested their case.
The prosecution recalled Officer Ryan Richardson. Deputy District Attorney Luke Bernthal asked Richardson about Steve Shapiro.
Remember my analysis about the prosecution the day Steve Shapiro testified? I said when Shapiro was questioned again would be relevant.
The first question today by Deputy District Attorney Luke Bernthal was asking about when Shapiro became someone the police suspected might have helped Goldberg get home after he dropped off the van.
Officer Richardson testified that Shapiro was not questioned again until February 2018 and this was after a conversation with the prosecution team.
Before February 2018, Chad Holub and Steve Shapiro were not in the radar as possible people who may have helped Jon Goldberg get home.
So before February 2018, how Goldberg was not an issue?
Why waste recalling Officer Richardson about a witness whose testimony may not even be taken seriously?
I left a few minutes early again because there is tons of other news that is not getting covered while the prosecution wastes time. You will see that nothing new or significant was added to Officer Richardson's testimony.
After two of my posts, Mr. Bernthal's demeanor improved briefly in the mornings but it does not last long. As the defense does well, Mr. Bernthal's frustration shows.
Here is another example of Mr. Bernthal's handling of the case from today.
Does he think it is the defense's job to prove claims in his case? No one so far except Rachel Goldberg's friend Frieda Smith has testified about any domestic violence between the Goldbergs. Rachel Goldberg was subpoenaed by the prosecution for a preliminary hearing in which she was the alleged victim. She refused to testify.
On cross examination of the defense expert, David Holland, Deputy District Attorney Luke Bernthal questioned Holland about three texts. First, we had to wait two minutes or more for Deputy District Attorney Bernthal to find three texts watching him scroll. All three texts were from Rachel Goldberg were to her "mom". That is how the phone was labeled on the DA's report.
One of those texts was, "“Make it clear to the motel clerk clerk that you are fleeing from domestic violence and they are not to give your info to anyone.
The other two were about returning the school van.
Then Mr. Bernthal asked Holland why these texts were not included. The defense had already made it clear on direct, then again on cross that Deputy Public Defender Casey Russo had told Holland what phones to focus on and the scope. The prosecution did not present all texts in their report with DA Investigator Perrone.
A few lawyers outside this area who have beento Humboldt and in this area agree with my insight on the case
Before this case, I got along great with both Mr. Bernthal and Mr. Timm. After this, I hope we will, again. Mr. Timm is second chair and none of my criticism is directed at him. This is Mr. Bernthal's case. Even though it is awkward, I call it as I see it.
Reporting is not worrying about being popular. If you want to stroke egos, public relations is a well paying career.
