$500,000 bail for murder and robbery suspect in Yorkville marijuana garden case

ORIGINAL PRESS RELEASE:

On 09-27-2015 at 7:18 AM the Mendocino County Sheriff's Office received a report of a possible shooting in Yorkville, California.

A person called into the Mendocino County Sheriff's Office dispatch center and advised they had received a telephone call from a 25-year-old Adult Male they knew who reported that he had been shot while at a marijuana garden.

Deputies were able to contact the 25-year-old Adult Male by calling his cellular telephone and were guided to a remote wooded location near the 37000 block of Highway 128 in Yorkville.

Upon contact the 25-year-old Adult Male was found to have multiple gunshot wounds and was subsequently transported by air ambulance to an out of county hospital for medical treatment.

The 25-year-old Adult Male had sustained life threatening injuries but is expected to survive those injuries at this time.

Sheriff's Detectives were summoned to the scene to further investigate the incident.

This investigation is on-going at this time and no further information is available for release.

Any updated information that does become available over time will be released by a subsequent press release.

UPDATED PRESS RELEASE:

On 09-27-2015 Sheriff's Detectives conducted a foot search of the area where the injured 25-year-old Adult Male was found.

Sheriff's Detectives traveled approximately .25 miles over mountainous terrain and located a marijuana garden site of approximately 200 plants.

An unidentified deceased Hispanic Adult Male with apparent gunshot wound(s) was found in close proximity to the garden site.

During the course of subsequent investigations Sheriff's Detectives arrested Isidro Lopez-Bernal (26-year-old male from Ukiah, California) and Mario Godinez (25-year-old male from Cloverdale, California) in connection with the incident.

Both were contacted and arrested in different locations in Cloverdale, California.

Both were booked into the Mendocino County Jail on charges of murder and robbery, each to remain in custody in lieu of $500,000.00 bail.

The injured 25-year-old Adult Male's involvement in the incident is still under investigation at this time.

The location of the marijuana garden site appeared to have been established as a result of a trespass onto privately owned property.

A forensic autopsy on the unidentified deceased Adult Male is scheduled for 09-29-2015 and identification is pending.

On 10-07-2015 Sheriff's Detectives identified the unidentified deceased Adult Male as being 43-year-old Marcos Bautista from Cloverdale, California.

The forensic autopsy conducted on 09-29-2015 determined Bautista had died as the result of multiple gunshot wounds.

UPDATED PRESS RELEASE:

On 10-08-2015 at 4:43 PM Sheriff's Detectives booked Edgar Fidel Contreras into the Mendocino County Jail on charges of murder and robbery in connection with this case.

Contreras was the 25-year-old Adult Male that had been located by Deputies on 09-27-2015 after the shooting incident was reported.

Contreras is expected to be held in lieu of $500,000.00 bail.

Victim's family walks out upset with yet another continuance in the David Lockhart case

No courtroom available and defense requested another continuance. Despite objections by the victim's family, represented by Mr. Patrik Griego who referred to "numerous continuances in this case", Judge Feeney said this was a time waived case, there were no courtrooms, he "regretfully" granted the continuance.

Lockhart is represented by Mr. Russ Clanton, his associate Mr. David Celli appeared in court on his behalf. Deputy District Attorney David Christensen is prosecuting the case now, instead of Ms. Jackie Pizzo.

New preliminary hearing date is November 5 at 8:30 a.m.

Preliminary hearing for David Lockhart charged with gross vehicular manslaughter is rescheduled for October 8

David Lockhart, is chared with a felony: homicide with the count of gross vehicular manslaughter and death of multiple victims. Yesterday, there was an intervention hearing in Courtroom 2 and the preliminary hearing for September 15 was vacated and a new date of October 8 was scheduled.

The Baker family, who lost their loved ones, have local  attorney Patrik Griego to represent them.

Deputy District Jackie Pizzo has been handling the case for the People. Mr. Russ Clanton represents Lockhart.

The District Attorney's office filed a stipulation and order on September 2 for independent analysis of a controlled substance.

California Highway Patrol press release:

On November 12, 2014, at approximately 1730 hours, a 2002 Chevrolet Silverado pickup, driven by 48 year old David Lockhart of Weott, CA, was traveling south on US-101, north of Garberville. A 2012 Chevrolet Suburban SUV, driven by a 24 year old resident of Rio Dell, CA, was traveling north on US-101, north of Garberville. For reasons still under investigation, the Chevrolet Silverado pickup made an unsafe turning movement and traveled across the center median, into the northbound traffic lanes of US-101, while still traveling south.  The Silverado pickup subsequently collided head-on with the Suburban SUV in the #2 lane of northbound US 101.

Drivers of the both vehicles as well as the passenger of the Suburban SUV suffered major injuries as a result of the collision.  The driver of the Suburban SUV later succumbed to her injuries and was pronounced deceased at Jerold Phelps Community Hospital. The names of the Driver and Passenger of the Suburban SUV are being withheld pending notification of next of kin.

California Highway Patrol, Humboldt County Sheriff, Cal-Fire, Garberville Volunteer Fire department, and Redway Volunteer Fire department all responded to the scene. This collision remains under investigation by the California Highway Patrol - Garberville Area.

Drug impairment does appear to be a factor in this collision.  At the time of the collision, airbags in both vehicles deployed, and all occupants were properly safety-belted.

People rest in Fieldbrook double murder homicide, defense begins case Tuesday

People rested their case today in the Jason Arreaga case. Tomorrow is a dark day in Courtroom 2 and Monday is a court holiday. Defense will start their case Tuesday.

Traffic stop results in marijuana, meth and an arrest

On 10-04-2015 at approximately 11:00 PM, Deputies from the Mendocino County Sheriff's Office conducted a traffic stop on a white Toyota Four-Runner with expired registration in the 29800 block of North Highway 101 in Willits, California.

As the driver was contacted, a Deputy standing on the passenger side observed a jar of marijuana in the cup holder inside the car.

A subsequent search of the vehicle resulted in the discovery of three methamphetamine smoking pipes and approximately one ounce of crystal methamphetamine.

The driver, Peter Ryan Rodriguez, was arrested for possession of methamphetamine for sale, possession of methamphetamine and possession of drug paraphernalia.

Rodriguez was booked into the Mendocino County Jail where he was to be held in lieu of $25,000.00 bail.

Matthew Foty of Texas just arrested in $64,000 bust same one as the one in Texas with a felony record?

EPD Press Release:

On 10/06/15 at approximately 9:11 p.m., Officers with the Eureka Police Department responded to a motel on the 2200 block of 4th Street for the report of a disturbance.  Once on scene, Officers contacted two males associated with a motel room.  The males were identified as Matthew Foty and Zachary Pereira, both 25 of Texas.

During the course of the investigation, Officers noticed a strong smell of Marijuana coming from the motel room.  A search warrant was obtained and the Eureka Police Problem Oriented Policing Unit (POP) and Humboldt County Drug Task Force (DTF) was asked to respond and assist.

Agents seized 50 pounds of Marijuana bud individually packaged for sales and over $64,000 in US currency.  Foty and Pereira were taken into custody on suspicion of possession of Marijuana for sales and booked into the Humboldt County Correctional Facility.

Terry Supahan is the new executive director of True North. Many will be familiar with him from the Planning Department of the Hoopa tribe and as former Councilman of the Karuk tribe.

Detective Greg Musson finished testifying in the JAson Arreaga case this morning and Detective Todd Fulton briefly took the stand. Mr. Kaleb Cockrum from Conflict Counsel sat in court as his attorney.

Mr. Cockrum had come in with some paperwork during court before the morning break and spoke with Ms. Heidi Holmquist and then along with Deputy District Attorney Zack Curtis they privately chatted with Judge Miles.

Judge Miles said court will take a longer recess. After the break, Jerry Bachus who was arrested yesterday took the stand.

Bachus is the third witness to testify and point towards Arreaga as the shooter, however just like Carly Michaels, Arreaga's ex and Shavonne Hammers, ex of one of the victims Harley Hammers, no one actually saw Arreaga shoot Hammers or Angel Tully. Bachus went back and forth about whether he saw Arreaga actually shoot Tully.

Rodney Coombes said he saw a man with a gun and IDed Arreaga as that man.

Shavonne Hammers, Carly Michaels and Jerry Bachus, all were given immunity by the DA's office for their testimony.

Michaels has been the only credible witness so far. With others, Ms. Holmquist has been able to raise questions about their testimony and doubts about their credibility. Will it be enough for reasonable doubt given that People's witnesses point to Arreaga as the shooter.

Bachus's testimony was all over the place about what he saw even when he was being questioned by Mr. Curtis. Ms. Holmquist during cross got him to admit to using meth since he was 12. He said he "now smokes weed and drinks" since he quit using meth in June 2015.

Compared to the photos shown in court, Bachus now has a shaved head. Dressed in an orange jail jumpsuit with his cuffs and chains removed for testimony, he said once the Gold buick driven by Arreaga left the scene, he ran back across the street to give Tully CPR.

Bachus also described pulling into Angie Ellers driveway, parking and talking to Harley Hammers and diving on the ground as shots flew in the air. He also said when Harley Hammers and Tully pulled up, they got out of the car and Tully banged on the trailer asking for Shavonne Hammers to come out. This corroborates a part of Michael's testimony. He also said that a car pulled into the driveway and Michaels had testified that she told Shavonne that a car pulled up and "those people are back."

Bachus said Tully was a "lifelong friend and they went to school together." He said he knew Harley Hammers "because he was married to Shavonne."

Mr. Curtis started his direct examination of Bachus by asking him, "When was the last time you saw Shavonne Hammers?"

Bachus, "About a year ago. I saw her at the casino, then I seen her at Safeway. She was getting a bottle of Fireball."

He did not know Michaels name but described her as a thin, young lady with brown curly hair.

Bachus said that Shavonne Hammers told him she was going to Ellers' house. He was supposed to be going to Blue Lake Casino but he had not seen Shavonne Hammers "for a while." so he went to Ellers house.

He said he pulled into the driveway and described a gold car parked near a trailer. He said Ellers was there briefly then left. "Shavonne and the young lady went into the trailer. A car comes pulling into the driveway. Ms. Tully gets out of the car. She banged on the trailer for Shavonne to come outside. Mr. Hammers exited on the other side and started looking around."

Bachus said that Harley Hammers asked him, "You know the guy with the gold car. The mother fucker shot at my feet." Then Bachus said that he dove down as a "bullet whizzed past his head."

Mr. Curtis showed Bachus a photo. "Yeah, yeah that's where I was standing," said Bachus. He then jumped up to show where in the photo (on the bulletin board behind him) and the additional bailiff standing next to him said, "Sit down!"

He then took a laser pointer handed to him by Mr. Curtis and showed where he was standing and where Harley Hammers was standing. "Next thing I know Arreaga came up and started shooting." Bachus then pointed to his head. "I'm down behind my car thinking, is this really going on? Arreaga goes pop, pop, pop."

Then Bachus mumbled something and was all over the place from down on the ground to across the street to check on Harley Hammers. He said, he saw " a car, the gold buick pulling out and Shavonne yelling, help Angel."

Then asked a question by Mr. Curtis, Bachus said his hearing was bad and he could not hear anything.

Mr. Curtis: "Did you see Mr. Arreaga take out a gun?"

Bachus: "I didn't see him take out a gun. I was standing with my back to him. I heard bam, bam, bam, only 1 gun."

Earlier, he did not say anything about seeing Tully being shot, at this point in his testimony, Bachus said he did see Tully being shot, "one time in the middle of the chest." Then he said he ran across the street to give her CPR. "I administered CPR on her but she wasn't responding," said Bachus. "No one was coming to help. I was screaming on top of my lungs and she was dying."

Bachus said that law enforcement arrived 15 to 20 minutes after the shooting. He said, "I think her (Shavonne) and the young lady went into the trailer" when asked a question by Mr. Curtis.

Mr. Curtis: How do you know Jason Arreaga?"

Bachus: "From papers. I don't know him at all. He was on the front page of the newspaper."

Bachus then IDed Arreaga in the courtroom.

"You are dressed in orange which means you are in custody," is how Ms. Holmquist started her cross examination.

Bachus said yes.

"You were subpoenaed Monday, showed up on Monday and some point left?" asked Ms. Holmquist.

"I didn't feel good," responded Bachus.

"Were you on meth?" asked Ms. Holmquist.

"No, I just didn't feel good," said Bachus.

Ms. Holmquist asked if he spoke to a DA Investigator in the last two days and Bachus said he did. He also confirmed in court he was arrested yesterday.

Ms. Holmquist asked him, "Do you remember saying on Monday that you do not remember anything?"

"Yeah," said Bachus.

"But you remember things today?" said Ms. Holmquist.

"Yeah," said Bachus.

Ms. Holmquist asked him if he signed an immunity agreement with the DA's office and he said he did.

"The only way you can get out of custody is to testify?" asked Ms. Holmquist.

"Yeah," said Bachus.

Asked about whether he uses meth, Bachus said that he did but quit in June this year and that he "now smokes weed and drinks." He had been using meth since he was 12, he is now 39 years old.
He said he just quit using meth without any treatment program.

Ms. Holmquist brought up his lengthy criminal record. This June he plead to a misdemeanor for meth. Starting from 2002 to 2015, Ms. Holmquist read specific dates and crimes he was convicted for from felony grand theft to stolen property to driving a stolen car.

Seth Morton jury trial for alleged home invasion and robbery of his own mother's home continued

The jury trial for Seth Morton scheduled for October 13 has been continued as was today's trial readiness by stipulation.

A disposition and reset hearing is scheduled for October 29.

He was held to answer on all charges after the preliminary hearing in July.

Seth Morton preliminary continued, now scheduled for June 1

DDA Andrew Isaac was present for the People today in Courtroom 2. Mr. Casey Russo, from the Public Defender's office is representing Morton. The People did not object to the continuance. Judge Marilyn Miles said "good cause" had been shown. There were no details given. Morton entered a general time waiver today.

Intervention is on May 19 at 3 p.m. and Preliminary hearing is scheduled for June 1.

Over the past several months, the Eureka Police Department’s Problem Oriented Policing Unit has been conducting an investigation into heroin trafficking within the Eureka area. As a result of that investigation, officers and detectives with the Eureka Police Department served multiple Search Warrants in Fortuna on Tuesday, 09/01/15.

The warrant services resulted in the seizure of approximately 1.1 lbs. of heroin, 2.7 grams of methamphetamine and $16000,00 cash. Gilberto Giron-Ramirez (40) of Fortuna, was arrested for Possession of Heroin, Possession of Heroin for Sales and Conspiracy. Pedro Sierra-Pozos (43) also of Fortuna was arrested for Possession of Heroin, Possession of Heroin for Sales, Possession of Methamphetamine and Conspiracy.

Both Giron-Ramirez and Sierra-Pozos were transported to the Humboldt County Correctional Facility where they were booked then released on their own recognizance.

Bachus is a key witness in the Jason Arreaga jury trial. He discovered Tully after Arreaga, Carly Michaels and Shavonne Hammers had left the scene.

He tried to give her CPR, several witnesses described him as upset, and had blood on him.

Case dismissed! Man leaves courtroom smiling after he dodges felony assault charge

I know his name and his defense attorney's name but it is the facts that are more germane here.

A man scheduled to have a preliminary hearing for a felony, assault, instead heard the Deputy DA tell the Judge the People's decision. The Judge then said the lucky two words: Case dismissed!

According to the defense attorney, the alleged victim, the guy's brother did not want to press charges. On the night of the alleged matter, the guy was sleeping. His brother burst into his home and demanded sunglasses. The guy refused. The brother who may have been intoxicated, threatened to burn the house down, so the guy went and got a rifle and made the brother leave. The alleged victim told Hoopa police that he was being shot at, despite both stories, the guy defending his wife and child and property was arrested and charged.

Ergo case dismissed.

Another case I heard about from a source close to the alleged defendant was that a guy working for one of the local tree companies was arrested for arson. Witnesses said he was at the scene of the alleged crime. He spent six weeks in jail. The case was dismissed after it was discovered he was at the casino at the time the alleged crime occurred.

DDA Whitney Barnes wins her first jury trial against the same attorney she lost against

Deputy District Attorney, Whitney Barnes, who was hired by DA Maggie Fleming at the beginning of this year won today's trial against the very attorney she lost the first jury trial to, Mr. Marek Reavis. That first trial was a domestic violence case.

She now joins this year's newly hired colleagues, DDA Trent Timm and DDA David Christensen who also won their first jury trials.

Davidsen was represented by Mr. Reavis who is with the Conflict Counsel's office.

Press Release:

On October 6, 2015, the jury found 43-year-old Amber Rachelle Davidsen guilty of illegal possession of a weapon, and battery - both misdemeanors. The defendant was found not guilty of misdemeanor assault by means likely to produce great bodily injury.

The case arose from an incident in King Salmon on February 22, 2015 when, during an argument, the defendant hit her neighbor in the head with an expandable baton and then pepper sprayed her. The Humboldt County Sheriff’s Department responded to a call for service and arrested the defendant after investigating the incident.

The case was prosecuted by Deputy District Attorney Whitney Barnes, with assistance from District Attorney Investigator John Burke. Judge John Feeney presided over the three-and-a-half-day trial. The defendant was sentenced to four days in jail, three years of probation, and ordered to stay 100 yards away from the victim in the case.

Preliminary hearing for man charged with 16 felonies of alleged sexual acts with child under the age of 10 postponed

A preliminary hearing was scheduled for David Viveiros this morning. Deputy District Attorney Brie Bennett is prosecuting this case. Public Defender Luke Brownfield is representing Viveiros.

Mr. Brownfield was in a multi day preliminary hearing and Mr. Kevin Robinson from the Public Defender's office appeared on his behalf and told Judge Joyce Hinrichs that the defense was requesting a continuance.

Ms. Bennett said, "the victim is upstairs and ready to proceed."

Due to schedules, the preliminary hearing was continued to October 20 at 8:30 a.m. with an intervention to confirm that date on October 19.

David Viveiros is charged with 16 counts of alleged sexual acts with a child under the age of 10 PC 288.7 (a).

Counts 1 and 2 sexual intercourse/sodomy; Count 3 oral copulation/penetration; Count 4 and 5 sexual intercourse/sodomy; Count 6 oral copulation/penetration; Count 7  and 8 also sexual intercourse/sodomy; Count 9, 12 and 15 oral  copulation/penetration; Count 10, 11, 13 and 14 sexual intercourse/sodomy and Count 16 is aggravated sexual assault of a child under 14.

All charges are the same victim.

He is charged with 16 felonies and Judge Cissna said there are "additional allegations against him which are serious felonies/strikes."

Possible Norteno gang member and a wanted murder suspect by the Salinas police may be in Eureka

The Eureka Police Department was contacted by the Salinas Police Department’s Investigative Unit and advised a wanted murder suspect was possibly in Eureka.  According to Salinas Detectives, the suspect reportedly spent last night behind the Bayshore Mall.

The suspect is wanted for attempted robbery and murder.  The suspect is a parole absconder with a history of violence and is believed to be a Norteno gang member.  Salinas Police Department considers him to be armed and dangerous.

The suspect is Nicolas “Brad” Azcona, 23 years old, 6 feet tall, 215 pounds, blonde hair, and blue eyes.  Anyone with information on his whereabouts should call 911 immediately.
