There was a Case Management Conference yesterday. Humboldt Superior Court Assistant Presiding Judge Timothy Canning was not in yesterday. Humboldt Superior Court Presiding Judge Kelly Neel called the Courtroom 4 calendar.
Nieman's attorney filed a CMC statement and deposited jury fees on 5/7. Judge Neel said the statement had not been uploaded to e court. She did not address why it was not in the file. This was the second case in Courtroom 4 yesterday that this happened but it happend quite often in civil court; less in criminal courts.
Nieman's attorney, Mr. Alan Reinach,said there had been no settlement talks; initial discovery had been exchanged and that early settlement should be explored.
The out of area attorney hired by City of Eureka, Mr. Ryan Ichinagaz, agreed.
Judge Neel said no trial date would be scheduled until parties engage in good faith discussions regarding potential settlement.
Further CMC was scheduled on September 4 based on schedule of attorneys.
