Humboldt court granted diversion to Andrew Iverson, now EPD had to request a gun violence restraining order against him after he refrenced Columbine, his interactions at Eureka High School, Iverson also made references to "KKK" and Epstein


This looks like the guy in Courtroom 8 today. Maybe he should update his Facebook profile?

I noticed a case on calendar last night which was on early this morning along with several other cases. It is a request to make  permanent a firearms restraining order or gun violence restraining order for Andrew Michael Iverson requested by Eureka Police Department. 

EPD Commander Leonard LaFrance is here with City of Eureka attorney City of Eureka attorney Robert Black. Managing Mental Health Clinician Jacob Rosen who is one of three people whose declarations are filed in this case.  The other two declarations are from EPD Sgt. Brian Ross and EPD Officer Christopher Baker who is the School Resource Officer. 

I am very impressed with Mr. Black in court.

Commander LaFrance's in person testimony was that Iverson was frustrated with crime in his neighborhood. Who isn't? Iversion was not happy with EPD officers and Sgts responding; he expected Commander LaFrance and Chief Stephens to personally respond to his house. 

Iverson, another client of Deputy Public Defender Emery Welton, granted diversion who now EPD, the courts and public have to deal with and who is wasting law enforcement, City of Eureka and court resources. Iverson took time away this morning and with his repeated calls and emails from people who could use  help, mental health assistance and EPD responding to other crimes.

If you read my coverage on repeat offenders such as James Leach, Analia Martinez and others; you know dismissal after "successful diversion" is a joke. There is a bill in California which I wrote about SB 1373.

This is Iverson's court record from Humboldt Superior Court. 



Iverson rambled on when it was his chance to testify and present his case. Humboldt Superior Court Commissioner Sarah Kaber gave him latitude and explained legal concepts.

Iverson's beef from his court testimony is students are walking and parking near his home and his claim that CSET and EPD Officers are not enforcing his interpretation of the law and there is no accountability.

I also deal with EPD as a resident. Granted, they know me from my work in media and before my reporting, as an involved business and community member but I also have seen hundreds of interactions they have had in the field over the 22 years I have been in Eureka.

Living in Eureka is frustrating if you are law abiding and considerate. I write about it all the time. I have been threatened. People get mouthy because they don't fear law enforcement. I don't even get rest when I go home. 

While listening to Iversion; some of his criticisms and frustrations are valid. The problem is what is true and what are his perceptions. If students are throwing trash on his property and Eureka City Schools'  response is , "would you like me to come pick up the trash?"; how would you feel?

Iverson repeatedly said in court that he has no evidence and documentation for some of his claims. In a court of law, you need to back up your statements.

Iverson rambling on about better police response in the Bay Area than EPD made me lose any temporary sympathy I had for him because he just reiterated his delusions have no basis in reality. If you, like Iverson, believe Bay Area is safer than Eureka and they have a better police response; feel free to move back there. 

Iverson says he does not own a gun. If everyone who said that in court was just taken on their word about firearms or any other claim; we wouldn't need any proof for anything in court.

Iverson says he feels dismissed by Eureka City Schools and  EPD. After you see the court filings; come to your own conclusions about EPD. As for Eureka City Schools; in my dealings with Suprintendents and some staff, off campus, they are arrogant.

Iverson's claims about bad parenting and students out of control is something many of us can relate to but we do not express our frustration the way he did.

This waste of EPD and court resources is a failure of our elected officials; Eureka City Council and all the local good ole boys and gals I call out repeatedly. Their failures result daily in clogging up the local court system.

Humboldt failed leadership is responsible for a  local, rural economy which mostly consists of people making money off pot or alcohol or grants and social services.  Retired boomers, nepo generational Humboldt babies, people with inheritances and unemployed keyboard warriors sit at home behind a computer screen contributing nothing but being persnickety and criticizing those who work. This is what creates a waste of resources, misdirected anger and lack of accountability. 

11:50: Commissioner Kaber issued her ruling and granted a 1 year permanent restraining order. There was already a temporary restraining order in place. Her comments were exactly what I wrote before her ruling. Commissioner Kaber said while she understands Iverson's frustrations, his response was disproportionate. Iversion said he and his spouse contemplated getting a gun and after his testimony in court, Commisioner Kaber read the criteria for a gun violence restraining order. 

We don't need press releases on traffic stops, EPD Chief Brian Stephens. You have two PIOS. Inform people of more serious arrests and gun violence restraining orders. If I didnt check this case and cover it, would the community know?  

EPD never informed the community of the Iversion TRO . Had they, I could have got the documents earlier to include with my initial instead of another additional, time consuming waste of time in Humboldt dystopia.

Some observations from the courtroom and additional information from court testimony.

Commisioner Kaber was very patient with Iverson. Within what she is legally allowed, she explains to pro per parties the procedure and legal concepts. Iverson had an attitude with her from the beginning which shows he isn't receptive to help.

Iversion emailed Eureka Mayor Kim Bergel  He wanted EPD Officer arrested.

Commander LaFrance testified, "Often dealing with crime in neighborhood is frustrating. Usually, there is an understanding by community members." Commander LaFrance said that there was "no understanding" and "agitation" by Iverson.

Rosen when he was recalled to the stand by Mr. Black said, "I don't believe there are any serious mental issues. There is no indication these statements are due to hallucinating or schizophrenic behavior." 

Rosen said Iverson had "anger management issues."
