Tyler Colegrove is scheduled for late arraignment this afternoon. The DA filed a complaint today with Count 1 PC 211 robbery as a felony. Count 2 PC 417 (a) (2) (a) exhibiting a concealable firearm in public as a misdemeanor. Alleged victim in Count 1 is Peter Nakyaaw Blake.
See my earlier post with the gun found at Dawn Colegrove's house.
When I checked with the court bailiff, he told me out Colegrove is not in custody. I called the jail and was told he is in custody. We will find out soon enough. Court will re-open at 3 p.m. when attorneys get here.
Colegrove's arraignment concluded at 3:02. No one was in the C ourtroom 3 except Humboldt Superior Court Judge Steven Steward, the bailiff and court staff. I saw Sage from LOCO and Robert Schaulis near Courtroom 1.
The jail was correct. Colegrove is in custody. Apparently, we were waiting for Gregory Kreis.
I saw Deputy Conflict Counsel David Nims talking with Colegrove. I heard him say, "Mr. Kreis can always substitute in."
The case was called on record.
Colegrove was planning to retain Kreis. When Judge Steward asked Colegrove if he knew where Kreis was, Colegrove responded, "Last I know he is out of town."
Judge Steward told Colegrove he was going to appoint Conflict Counsel. OR bail is on 3/23. Referral to supervised release. Preliminary hearing is on 4/2. Bail is $180,000.
Between the time I checked the complaint and arraignment, a special allegation was added for Count 1 and an amended complaint. There is also a co-defendant, Eric Jason James Marshall.
I will update and add the complaint.
