Sergio Frias' sentencing being continued highlights the chaos of criminal justice in CA and who is to blame

Sentencing had already been continued twice by defense for convicted felon and  sex offender Sergio Frias. Today, Frias' case was on calendar for sentencing and receipt of report after a diagnostic evaluation. It has been continued again to April 13 by Humboldt Superior Court Judge Steven Steward.

As frustrated as the victims are, the DA and I am too; Judge Steward made the right decision. The criminals and their enablers, which in many cases includes family members and friends in denial, short staffing, budget cuts and most of all the incompetent elected officials and soft on crime California legislators have created this mess which increases daily. 

Throw in drug tolerant rural Humboldt and local officials who have done nothing to improve the non existent, private economy and the societal ills get played out in the courtrooms of Humboldt.

The November 7 post has details about his plea and the resolution of four cases.

Deputy District Attorney Carolyn Schaffer is the prosecutor who handled all the cases. Gregory Kreis is Frias' attorney.

Kreis spoke with Frias before the case was called. 

The first delay was that Ms. Schaffer and Kreis did not have the report so they had to view the Court's copy.

Judge Steward said, the report was dated January 30, 2026. "I am not sure why there was a delay and attorneys were not served a copy."

"Given the nature of the report, the psych evaluations and number of recommendations," Judge Steward "found good cause to continue sentencing."

Judge Steward did acknowledge Ms. Schaffer's objection and concerns about the impact of a continuance on Jane Doe and family. Jane Doe's mother was present via Zoom.
