At arraignment, the DA's office had indicated they would file a PC 1275. 1 motion which requires the defendant to prove money or property used for bail was acquired legally and not through criminal activity.
I checked all morning several times and the DA just filed an order shortening time and a motion but it does not indicate what the motion is and I don't know yet if the OR bail hearing will be continued. It is a motion regarding bail.
3/16/26: OR & supervised release denied by Judge Killoran. DA OST for bail motion denied due to late filing.
3/18/26: DA filed a motion yesterday to advance the March 25 preliminary hearing. There was no one in the courtroom this morning when the case was called except Humboldt Superior Court Judge Steven Steward, Deputy DA Rebecca Buckley-Stein, court staff, the bailiff, myself and one Victim Witness Advocate.
Ms. Stein said she notified Tonev's attorney, Ms. Andrea Sullivan yesterday. I spoke with Ms. Sullivan who was not there because she had no idea this motion was on calendar. It was continued to 1:30 this afternoon. Tonev tried to ask Judge Steward what the motion was about; Judge Steward told him he could not discuss anything without Ms. Sullivan and cautioned Tonev about making any remarks on record. 1:30 p.m. update: No other media was in court. Again, it was just me and Victim Witness Advocate. The DA wants the preliminary hearing scheduled before Monday 3/23 which only leaves Thursday and Friday this week.
Ms. Sullivan told Judge Steward if Ms. Buckley-Stein had emailed her the motion, "I haven't had a chance to review it. I object. I am starting a life top case in Riverside County tomorrow. I am available 3/25/26."
Ms. Buckley-Stein said, "the necessary witness Deputy Pryor is not available for that date. As soon as I found out; I promptly filed the motion."
The 10th for the preliminary hearing is 3/26/26. HCSO Deputy Justin Pryor is only available Thursday and Friday this week and gone all of next week making him unavailable before 3/26/26. He is traveling to Illinois for a training.
"I live in Southern California," said Ms. Sullivan. "I made travel plans which are expensive. I prejudice myself and my client. I am ordered to be in certain places Thursday and Friday. The DA has options. The DA can do a permissive filing. The right to have counsel triumphs the Deputy's training."
"This preliminary hearing was scheduled since March 12," said Judge Steward. "It was filed yesterday on 3/17. The only two days the Court can set the preliminary hearing is tomorrow or Friday. I understand law enforcement needs to engage in professional training but at this time, I will deny the motion to advance the preliminary hearing. Deputy Pryor will have to cancel the training or People have to find options."
DA's motion was denied by Judge Steward. I agree with Judge Steward and Ms. Sullivan. Preliminary hearing remains set for 3/25/26.
Later this afternoon, as I was walking out from the Courthouse, Deputy Pryor was walking in the building. I took this photo.
