Tomorrow morning, the preliminary hearing in terroristic and criminal threat suspect Daryl Jones' case is scheduled to resume with closing arguments and ruling from Humboldt Superior Court Assistant Presiding Judge Timothy Canning.
This hearing has been scheduled since January 7. I have been checking this case for over a week now because I expected a defense motion to continue. This based on covering Humboldt Superior Court and knowing the attorneys. I also have not seen Conflict Counsel Supervising Attorney Megan O'Connell who represents Jones.
This morning; nothing. This afternoon, at the very last minute, when I checked the case, there was an order shortening time filed by Conflict Counsel. A few minutes later at 3 p.m. an entry for motion to continue.I informed Humboldt Superior Court Assistant Court Operation Manager Scott Anderson and then contacted Deputy District Attorney Roger Rees who didnt even have any knowledge of this late filing until I told him.
I could have waited until tomorrow morning to post this but thought maybe community members who have an interest in this case should know. It maybe helpful to other local media but they were not there all the time for 5 days of the preliminary hearing and I don't know who will show up in person tomorrow.
I will add the update from tomorrow to this post. It is a very busy time with a lot of cases, local news and breaking national news. I am very curious to see why the last minute filing by defense.
