After what Jane Doe endured, Arda Kizilay better not get probation

 

Yesterday, I did an all day, live coverage of the plea deal of convicted sexual batterer and sex offender Arda Kizilay. It took all day because two Turkish interpreters had to translate everything. 

After my post yesterday, the victim in this case emailed and thanked me. No other media was in court yesterday or followed up on Kizilay after the arrest.

I explained that I would do a separate post on the plea because the details in court are not in the minutes. Humboldt Superior Court Judge Killoran went over the plea meticulously. The factual basis was stated in court which explains for the first time what happened and what led to Kizilay's arrest and confirmed my research that Kizilay worked for Door Dash. 

Deputy District Attorney Carolyn Schaffer is the prosecutor. Ms. Kathleen Bryson is Kizilay's attorney. Kizilay, mostly looked resigned and defeated. When Ms. Schaffer was stating the factual basis which is a summary of probable cause, hearing what Jane Doe endured was difficult enough but Kizilay interrupted at one point, "no, no" and Ms. Bryson had to hush him and explain. So, he does understand English and was able to talk to the victim but taxpayers needed to pay for two interpreters who will also assist with a pre-sentence report and sentencing. I heard him speak; he understands and can communicate in English enough where no translation is needed.

I like to do my posts chronologically but it is another busy day and all court day so I will add the factual basis now and then go back and add Judge Killoran going over the plea shortly or later when I have time.

Ms. Schaffer: "On June 18, 2025, at about 5:30, an officer was dispatched in Eureka which is a city in Humboldt County, CA. Jane Doe reported she had ordered a bottle of alcohol through Door Dash. The delivery driver was the defendant. Jane Doe was contacted by the defendant and asked to show I.D. When Jane Doe opened the front door, defendant told her that her eyes were beautiful." He then pushed Jane Doe's front door, grabbed her and was holding her arms. Jane Doe told him to stop. He pulled up the front of her shirt, exposing her breasts, ran his tongue on her breasts. Defendant used one of his hands to rub her genitals over her clothing. Defendant rubbed his genitals against Jane Doe's genitals while both were clothed. During this incident, Jane Doe was afraid to physically resist the defendant. Defendant told Jane Doe he needed to repark his vehicle. When he left, Jane Doe closed and locked the door. Defendant attempted to come back in the residence; then left."
