Former Planning Commissioner claims he is indigent; Judge reduces bail but calls Brian Mitchell out on being arrested while out on supervised release

 


Former Security National employee, former Humboldt Planning Commission member and  County Assessment Appeals Board member Brian Mitchell was granted supervised release on 9/27. He was arrested again on 10/6. I added the update about him being arrested again to the last post.

Today, there was a hearing on probation's recommendation to terminate supervised release. I was in court today and Mitchell is now clean shaven like he used to be years ago. He stood quietly and allowed his attorney, Deputy Conflict Counsel R.J. Leohner to communicate for him. 

A financial statement was given to Judge Kaleb Cockrum and Deputy District Attorney Candace Myers. 

Ms. Myers said she could not comment because, "there is no way for me to verify."

"The defendant is indigent according to the form," said Judge Cockrum. "I have to balance protection of the victim until preliminary hearing. Usually, I would release with conditions. They were not sufficient in this case."

Judge Cockrum reduced bail to $25,000 based on "prior court performance and supervised release."

Supervised release was terminated. On 10/18, there is a motion to file an amended complaint and the preliminary hearing. The 11/8 date was vacated.
