Trial confirmation was scheduled for murder, assault and robbery suspect Richard Dean on March 12. Jury trial for 3/23. Once again, Dean's case did not resolve because Dean agreed to a plea but keeps delaying the process. Judge Wilson set one more trial confirmation on March 16."Listen to your attorney," he told Dean.
There have been several efforts to resolve the case. Most recently, three hearings and today, another continuance.
Deputy Public Defender Ben McLaughlin is Dean's attorney. Deputy District Attorney Stacey Eads is the prosecutor for this case.
Mr. McLaughlin conveyed Dean's latest offer for a determinate term to Ms. Eads. That was rejected by the People. "I am still optimistic the case will resolve," said Mr. McLaughlin.
Ms. Eads said that if Dean does not honor the plea deal by 3 p.m. tomorrow, the People will withdraw the offer and the case would proceed to trial.
Dean previously conveyed an offer of 15 years to life and the People accepted that resolution. Part of the consideration was to the victims would avoid the trauma of trial. Ms. Eads mentioned the victims agreed to the plea and then there has been repeated calendaring for change of plea.
Based on the proposed sentence,it looks like Dean would plead to second degree murder.
Victim in the homicide case is Anthony Pennucci.
