Motion filed in Chad Smith's alleged molestation case to set aside the information, read why

The motion to dismiss was just filed. A first amended motion was also filed; the only difference is the time, 8:30 a.m. and Courtroom 3 is where it is scheduled to be heard . Here is page 1 of the motion. Defense is asking to set aside Counts 1 and 2.

Counts 1 and 2 are PC 288.7 (b) Oral copulation or penetration with a child who was 10 years of age or younger. Alleged victim Jane Doe #1.
