For someone on probation and facing assault charges, Kody Marcelli chooses to act out in and outside the courtroom?



Kody Marcelli is on probation for a plea he entered in a DUI case. Check out the timing of when the DUI case was filed, when the assault case was filed and the charges in each case. The DUI case is a 2017 case, the alleged assault happened in September 2017.

As a part of his plea deal, Kody Marcelli had his firearms returned to him because he took a basic gun safety course. In that DUI case, he was charged in the complaint with being drunk and carrying a loaded firearm in public.


Glaring at people, including me, in and outside court at hearings for his alleged assault case is something Kody Marcelli has done more than once. However, glaring was the least of Kody Marcelli's public tantrums today.

Throughout today's preliminary hearing, despite instructions on how to communicate with her and conduct himself during the preliminary hearing from his attorney, Kody Marcelli was vocal, reactive, making faces, interrupting with remarks during testimony and Deputy District Attorney Rees' questioning and rebuttal statement.

At one point, Ms. Heidi Holmquist Wells said STOP to him. When the hearing concluded, Kody turned around and glared at me as he walked out the courtroom. I was waiting outside to talk to Deputy District Attorney Roger Rees.

Kody  Marcelli was talking to his attorney and parents. He was on the other side of the second floor.  I wasn't interested in what he was doing or paying any attention to him until he looked  in my direction, glared and mouthed what and made an intimidating gesture with his body.

At that point, I yelled at him, "What's your problem?" His parents tried to calm him down and hold him back. What were you going to do Kody? Hit me and fail at another self defense claim?

This was after 5 p.m. It had been a long day with no breaks for me since 11 p.m.

A bailiff off duty (someone I usually get along with) someone who I didn't see around when the interaction occurred mouthed off to me and to "let it go". That and a rude remark by  some gossipy biddy holding the elevator inserting her opinion about something she has no clue about or was present to witness did not help and contributed to my verbal response to Kody Marcelli's immature behavior.

Yeah, I should just ignore Kody's beligerent and threatening behavior like the deputies did on September 5 so he thinks he can continue intimidating more people. That is what happens when people get special treatment by the system, by their buddies, and parents don't let their spoiled brats face consequences in small towns. Maybe if this County held people like Kody Marcelli accountable for their actions, I would not have to write om about what happens except for court. proceedings.

This same bailiff was all chatty with the Marcellis at arraignment. Others also came into the courtroom during that hearing just to socialize with the Marcellis. That is not usual behavior for bailiffs.

Kody Marcelli, it maybe inconvenient for you that I am covering this case. Letters of recommendation from people you know doesn't mean shit when your jerky behavior in public shows otherwise.

Also why was your buddy Jonathan Christian, a witness in your case and a passenger in the car with you at the time of the alleged incident talking with the two  HCSO deputies in this case before all of them testified for the defense? He slithered away when he saw me come out of the courtroom unexpectedly.

One of the deputies did not file his report on the September 5, 2017 incident until end of October 24, 2017. Another deputy, who was a correctional deputy for 7 years, and a HCSO deputy for only three made a decision not to arrest Kody Marcelli or collect video evidence at the time of the incident. Both deputies have three years experience on the job.

Would they have afforded the same treatment and courtesy to someone else? Did they bother to check Kody Marcelli's record?

  1. This is the problem with covering courts, exposing corruption in a small town and providing information that is usually ignored by others. You get attitude for simply doing your job.

    I really don't care who the Marcellis know or anyone else knows for that matter. Kody Marcelli and many local yokels are used to getting their way. Generational apathy and unaccountability for some is a Humboldt plague.

    Newcomers that actually try to change this place for the better face resistance, be it a reporter, lawyer or educator.

    Humboldt's little cliquey cabals anonymously and through gossip attack anyone challenging the Humboldt stagnant and entrenched status quo.In a small, rural, isolated County, there is a financial and social cost to speaking the truth.

  2. Disclosure: I know many people here and have for years, long before I started this blog. That is a result of being actively involved in business, politics and this community for 15 years. Gary Harner is one of those many people in this very small town and community.
