Sean Allman granted mental health diversion after Andrea Sullivan joins as co counsel

 


This morning after argument, Retired Judge John Feeney granted the defense petition and found Sean Allman eligible for mental health diversion. Judge Feeney ruled that Allman does not pose an unreasonable risk to the community

After years of unsuccessful attempts to resolve this case, this petition was filed after Ms. Andrea Sullivan was co-counsel on the case. Allman has been represented by Mr. Ben Okin. 

Ms. Sullivan has been successful in getting mental health diversion and results for other Humboldt defendants and her record shows why she has a practice that includes Humboldt, Mendocino and Lake, Trinity, Tehama and Butte counties. Allman is charged with Count 1 Terrorizing or obstructing exercise of religion. Count 2 is Criminal threats. Both counts pertain to the Episcopal Diocese of Northern California.

"Penal Code 1001.36 is the California statute that provides for mental health diversion. This program allows some people with mental health issues to receive treatment in lieu of prosecution and jail when they are charged with a crime."

"If the defendant successfully completes treatment, the criminal charges will be dismissed. The record of the arrest will then be sealed for most purposes and it will be as if the arrest had never happened."-Shouse Law

12/12: Hearing continued at defense  request to 1/18/23  so County Mental Health can submit treatment plan.
