Will kidnapping, child abuse, assault suspect now take a plea or go to trial?

 

On 10/31, In her 2022 case, kidnapping, child abuse suspect Bao Her who is also charged with battery on a police officer was held to answer after the preliminary hearing. Arraignment is on 11/17.

Deputy District Attorney Roger Rees was the prosecutor for the preliminary hearing. Deputy Public Defender Wade Orbelian is Her's attorney. Eureka Police Officer Ben Altic was designated the People's lead investigating officer. EPD Officer Doe Scadron testified for the People.

Pre trial in Her's 2021 assault and battery case was continued by defense for trial setting on 11/17.




11/17:  Trial setting was scheduled in Her's 2021 case. Pre trial scheduled in that case on 12/20/22 and 1/9/23.

Her was arraigned on information in her 2022 case. Trial confirmation is on 12/20/22 and jury trial on 1/9/23.

12/20: Pre trial in 2021 case continued to 1/3/23 due to earthquake emergency. Trial confirmation in 2022 case continued to 1/3/23.







1/3/: Pre trial date for 1/9 vacated. This 2021 case is trailing and pre trial is scheduled on the same dates as the 2022 case. Trial confirmation in the 2022 case continued by defense and was granted over People's objection. 1/9 date vacated. Trial confirmation on 5/2; jury trial 5/15.

5/2: Her 2021 case is trailing. The 5/15 pretrial date was vacated. In the 2022 kidnapping and child abuse case, the jury trial date of 5/15 was vacated. Defense is seeking mental health diversion. There is an OR/bail hearing scheduled for 5/9 to present arguments on mental health diversion. A bed is available at 7th Generation. Defense made an oral motion to continue trial. If mental health diversion is not granted, defense will file a 995 motion. Trial confirmation was continued to 8/15 and jury trial rescheduled for 8/28.  

5/9: OR/bail denied. 5/15 petition on mental health diversion +995 motion hearing. 

5/15:Continued to 5/22 for ruling on prima facie showing +995 motion.



5/22: Continued to 5/24:

5:24 :  In 2022 case, Judge Joyce Hinrichs needs treatment plan to grant mental health petition. People request contested hearing. 995 trailing mental health continued to 6/7. Trial confirmation and jury trial dates remain as scheduled. 2021 case trailing.

6/7: Ruling on mental health diversion on 6/9





6/9: Mental health diversion diversion granted. Review on 7/11/23.
