On 11/10, a mistrial was declared in alleged molestor Sergio Reynoso-Lozano's jury trial.
Deputy Public Defender David Celli requested a continuance in the middle of jury selection. Judge Kelly Neel granted the defense motion over the objection of Deputy District Attorney Whitney Timm.
Trial setting is on 12/13/22. Lozano is charged with 9 felonies and faces 50 years to life, if convicted.
12/13: Trial Confirmation on 3/27/23; jury Trial on 5/15/23.
3/27/23: Trial confirmation continued by stipulation to 4/17.
4/17: Trial confirmation continued to 5/3 but there is also a motion to continue by the Public Defender listed for 5/1. Jury trial is currently scheduled for 5/15.
5/1: Judge Kelly Neel denied the defense motion without prejudice. Deputy District Attorney Whitney Timm said there was no good cause, no due diligence. "It's been almost 6 months and that is not enough for investigation to be done." Trial assignment on 5/12; jury trial on 5/15.
5/12: At trial assignment, jury trial for 5/15 was vacated. Instead, the case is on for possible resolution or resetting of trial.
5/15: Was on for possible resolution /resetting of trial. Did not resolve. Dates reset. Mr. Celli's request to set in September was opposed by Ms. Timm due to victims' right to a speedy trial. Time estimate 3 week.Trial assignment on 5/26; jury trial on 5/30.
5/26: Trial assigned to Judge Cockrum. On 5/17, defense subpoenaed records from Alice Birney Elementary.
