A hearing to address restitution was scheduled on March 26 for two of the Manila 5 defendant, Tamara Thomson and Hector Godoy-Standley. There are different restitution amounts for different defendants.
Thomson appeared via video conferencing; she is represented by Mr. David Nims. Godoy-Standley's appreance was waived by his attorney,Mr. Russ Clanton.
Deputy District Attorney Carolyn Schaffer told Judge Christopher Wilson, "I haven't received any documents or information from probation due to the ongoing restraints due to the pandemic. It is defense's burden to rebut any amount."
Mr. Nims said he did not have any documents due to the current coronavirus situation. "I do not want to waive a hearing" and he did not know if a contested hearing was needed.
Judge Christopher Wilson said, " I can refer back to probation for unified request for all victims or people can contact victims through victim witness."
Ms. Schaffer asked that Judge Wilson "refer back to probation" for a unified request and documentation explaining different amounts of restitution for different defendants. "The family didn't retain copies given to probation."
Receipt of supplemental report is scheduled for April 30 and if necessary, a setting for evidentiary hearing will be scheduled.
