Federal judge orders U.S. government to release or grant hearings to 1,000 asylum seekers

According to the Mercury News, "A federal judge in Washington, D.C., on Monday ordered the U.S. government to immediately release or grant hearings to more than 1,000 asylum seekers who have been jailed for months or years without individualized case reviews, dealing a blow to the Trump administration’s crackdown on migrants.

U.S. District Judge James Boasberg of Washington said U.S. Immigration and Customs Enforcement ignored its own policy stating that asylum applicants who establish a “credible fear” of persecution in their native country must be granted a court hearing within seven days or released."

According to The Washington Times, "A federal judge punched another hole in the Trump administration’s get-tough approach to asylum-seekers Monday, ruling that the government must consider granting them parole to be released into the U.S. while their cases are being heard.

Judge James E. Boasberg said U.S. Immigration and Customs Enforcement was violating its own 2009 policy, and must return to that directive.

His order covers five different ICE offices where parole rates had dropped to near-zero, which he said meant the agency had essentially stopped doing individualized assessments and was just denying parole requests outright."

  2. It's rediculous to grant hearings to illegals. Grant them trials for the crime of entering the Country illegally first. Will this ruling survive and appeal?

    1. Rusty: The article points to hearings for Asylum seekers. Presenting yourself at the border of this country requesting asylum does not make you illegal. In fact Asylum is codified in both international agreements that the US is signatory to as well as in Federal law. Every passenger on the Mayflower was in effect seeking asylum in these lands. So Asylum is ingrained in our history and cultural heritage. For 150 years, you just came to this country on a boat. It was when race based restrictions reared their ugly head (around 1924) deciding who can come and who can’t that this became a political debate.

  3. Thank you Allan. My beef is with the illegal Boarder crossings that get to by pass the system. However seeking Asylum should be based on political or religious persecution. Not showing up in mass claming persecution intentionally overwhelming the system then demanding to be released while awaiting their hearing possibly never to be seen again thus making them yet another illegal draining resources. If one is truly in peril one can easily seek asylum at the American Embassy in their country or and adjacent country thus avoiding the perilous thousand plus mile Journey to the American Border. But that doesn't fit the liberal progressive socialist agenda and agenda to make a Socialist American and to make Socialist American they need voters and that's what they have at the Boarer. There's nothing racist about it it's pure politics and you know it.
