Expect the jury trial for Jesus Garcia homicide to be delayed, here's why


Joe Olivo III's case has been transferred back to criminal court. He will be tried as an adult.



At the time of the alleged crime, Olivo III was 17 years old. He is now 20 years old.

Judge John Feeney explained in detail the reasons for granting the People's request and his decision was pursuant to Welfare and Institution Code 707. Judge Feeney also referred to W & C 707 (a) (2)

Olivo III is being represented by Ms. Anakalia "Andrea" Kaluna Sullivan. She indicated that she would be filing a motion to continue.

On May 11, Olivo III will appear with his father, Joe Olivo Jr and Mario Nunez for trial confirmation. All three are charged with the death of Jesus Garcia.

Judge Feeney set Olivo III's bail at 1 million. A bail hearing is also scheduled for May 11.

Jury trial is currently scheduled for May 21. Trial estimate is 8 weeks.

Deputy District Attorney Brent Kling appeared for people in court this afternoon. Deputy DA Luke Bernthal who has been prosecuting the case was also in court.

Judge Feeney said Olivo III did not express fear of his father, who Judge Feeney said played a major role in Garcia's death. Judge Feeney said that while his father was in prison, Olivo III was arrested for multiple violations. This was after being released from the juvenile facility. Judge Feeney said that Olivo III should knowledge of gang hierarchy and power.

Originally, there were four suspects. Nicholas Leigl's case was resolved.
