Hugo Parral- Aguirre has a criminal past, he has been deported more than once, he has no prior mental health history. In addition to the deputies, he endangered the life of one citizen and put others nearby at risk
If it was not for California's sanctuary law, ICE would be dealing with Aguirre. Then, there are those "Humboldt court rules."
In Humboldt we have our own local court rules. Stated and "unstated." Court here is run like the Wild Wild West, with the Judicial Council and State of California apparently asleep or apathetic.
One local doctor can find a defendant incompetent, the local Judges just let the State deal with it. This is sometimes a temporary solution. The defendant is later deemed competent and the whole process starts again. If the first evaluation was not so cavalier, we would be saving more money in the long run.
We also have other rules that Visiting Judges have learned not to question. Public Defenders have told Visiting Judges that in this county all one has to say is I cannot afford an attorney and they get a public defender. In very rare cases, some local Judges but mostly Visting Judges have the defendant fill out paperwork to determine eligibility before appointing a public defender.Taxpayers pay for those legal fees and all other expenses, especially for frequent offenders.
Media requests for the courtroom are rarely granted. It is a local court rule that you cannot film anywhere on the second floor. Judges can just close the courtroom, whenever they feel like it; even if the courtroom is required by law to be open.
Who is paying the salaries of these Judges, the staff, the Judicial Council? Who is paying for the expenses of defendants who cannot afford a lawyer? Not just legal fees but the experts, the repeated Marsden motions, the mental health evaluations? Who pays for all this and repeatedly for the frequent offenders?
