The nth motion to continue, again, filed by defense for David Viveiros charged with 7 counts of alleged sex of a minor granted; case may resolve on October 10

David Viveiros's case from 2015 has yet to go to trial. Viveiros is charged with 7 counts that include charges of sex/sodomy, oral copulation/penetration with a child under 20 and aggravated assault of a child under 14 years.
Despite objections from the DA, continuances keep being granted. Deputy Public Defender has been representing Viveiros.
Viveiros court hearing on September 28 was continued to October 3. The trial confirmation  and motion to continue was continued, again to October 5 at 8:30 in Courtroom 3.

For the jury trial , Viveiros was arraigned on seven Counts.

Count 1 is sex/sodomy with a child under 10, Count 2 is oral copulation/penetration with a child under 10, Count 3 is sex/sodomy with a child under 10, Count 4 is sex/sodomy with a child under 10, Count 5 is sex/sodomy with a child under 10, Count 6 is sex/sodomy with a child under 10 and Count 7 is aggravated sexual assault of a child under 14 years.

David Viveiros was held to answer on charges after his preliminary hearing, the People did not ask for certain counts to be held. These counts were for sex/sodomy with a child under 10 and oral copulation/sexual penetration with a child under 10.

Before the preliminary hearing, David Viveiros was charged with 16 counts of alleged sexual acts with a child under the age of 10 PC 288.7 (a).

Counts 1 and 2 sexual intercourse/sodomy; Count 3 oral copulation/penetration; Count 4 and 5 sexual intercourse/sodomy; Count 6 oral copulation/penetration; Count 7  and 8 also sexual intercourse/sodomy; Count 9, 12 and 15 oral  copulation/penetration; Count 10, 11, 13 and 14 sexual intercourse/sodomy and Count 16 is aggravated sexual assault of a child under 14.

All charges are the same victim.

He is charged with 16 felonies and additional allegations against him which are serious felonies/strikes."
He also had a CLETS protective order served on him in court.

The case is being prosecuted by Deputy District Attorney Stacey Eads. Viveiros is being represented by Deputy Public Defender Luke Brownfield is representing Viveiros.

No other media has covered this case, like many others. I have followed this case from the beginning.

  1. No other media has covered the case...
    Of course not. There's always something more 'newsworthy' to write about. But the public does need to know there are those (I won't call them 'people', they're almost sub-human by their actions) out there who can steal a child's innocence and rob their adult lives of any measure of real happiness and the ability to have a sense of security.
    The crime is nasty, the story is nasty (even in its court-approved descriptions), and yes, it makes you want to turn away because even the thought of it makes you feel sick. But if you don't confront evil then you're giving it the ability to continue, ignored by all.
    No, it's not a popular subject. But how will parents and children's caregivers know that they have to protect the most vulnerable if they know there are monsters out there in human clothing?
    Thank you John for reminding people about this problem, and I hope we can soon read about a LONG sentence. A very long sentence.

  2. Frankly, Vermin convicted of these heinous crimes should be beaten to a pulpieness sufficient to flush down the toilet if the victim wishes it so.
