If you have Narcissistic Personality Disorder, are you incompetent or competent to stand trial?

On December 11, Judge Marjorie Carter heard testimony from an expert witness, Dr. Jennifer Wilson, giving a second opinion on whether Jacob Silverman was competent to stand trial. Dr. Ramirez had already found Silverman incompetent to stand trial.



Dr. Wilson "sort of disagreed." She diagnosed Silverman with Narcissistic Personality Disorder.

Deputy District Attorney Trent Timm and Silverman's fourth attorney on this Humboldt case, Mr. Russ Clanton questioned Dr. Wilson during the PC 1368 hearing. Silverman fired Public Defender Kaleb Cockrum, Mr. Joe Judge and Mr. Mark Hapgood.

Due to court scheduling, there was a break during the afternoon so Judge Carter could call the arraignment and OR/Bail calendar.

Silverman "got into it" with Mr. Clanton before the afternoon session yelling at him. He did not sit with his attorney but was cuffed and sat in the jury box, with the courtroom bailiff by his side. With a stack of manila folders by his side, Silverman scribbled notes.

That behavior continued in court with Judge Carter admonishing Silverman several times to be quiet and told him not to interrupt the court proceedings.

Silverman has been incarcerated in the Humboldt County jail for 14 months. He has previously had a stint of six years at Pelican Bay. Silverman has " studied law" when he has been in custody.

I am going to post separately on this afternoon's session and testimony of Dr. Wilson. Judge Carter indicated that she would give Silverman a chance to speak before her ruling. This hearing was definitely better than the endless PC 1368 hearings held in other cases. No real information is provided other than one line about the report are and the hearings drag on for months because they keep getting continued.

I have observed and heard Dr. Wilson talk outside the courtroom regarding a few cases. Based on what I have heard, she definitely has an activist and more public defender mentality. I could see that in the way she answered questions, especially from Mr. Clanton.

Mr. Clanton disagrees with Dr. Wilson's opinion.

Silverman agrees with Dr. Wilson's opinion. Deputy District Attorney Timm's questions indicated that he wanted a ruling that Silverman was competent.

I thought both attorneys asked good questions and presented convincing arguments. Silverman was difficult with his behavior but when he spoke, he was  cogent. His behavior at different times supported what Dr. Wilson said, Mr. Clanton said and what Mr. Timm said.

From Marin Indendependent Journal (2009):

"A man in the Mercedes, 38-year-old Jacob Silverman of San Francisco, also was arrested on suspicion of meth possession. He has been released on bail pending an initial court hearing on April 3."

2012 Police log --from Press Democrat:
12:50 a.m. — Jacob S. Silverman, 36, of San Francisco was arrested on Highway 101 on a felony outside warrant.

Ukiah Police Department (2014):

November 1st at about 11:55 PM Ukiah Police responded to a fight at a residence in the 100 block of Wabash Avenue.

Responding officers were advised the suspect had left the scene driving a gray pick-up. One of the responding officers spotted the suspect vehicle heading north in the 1100 block of South State Street, and tried to stop the vehicle. The suspect vehicle fled and a pursuit ensued, heading north on State Street. The suspect vehicle reached speeds of over 80 miles per hour and crossed into the on-coming traffic lane, and ran several red traffic lights.

The pursuit continued to the 1400 block of North State Street and as the suspect vehicle entered the southbound on-ramp to Highway 101, the driver lost control of the vehicle and ran off the roadway and into the dirt. The suspect vehicle was fishtailing and out of control as it returned onto the on-ramp where it collided twice with a pursuing police vehicle. The suspect vehicle spun sideways and off the roadway again where the driver attempted to drive up the embankment until two of the pursuing officers utilized their police vehicles to contain the suspect vehicle from continuing.
The driver and passenger fled on foot heading south with officers in foot pursuit.

The suspects split directions and the driver, later identified as 39 year old Jacob Silverman, of San Bruno, headed east and scaled a fence and continued running towards the rear of Raley’s Supermarket. Officers caught up to Silverman in the field behind Raley's and took him into custody. The passenger, 41 year old Danny John Ramos, of Pittsburg, headed towards the Yokayo Bowl and was able to elude officers temporarily. Ramos was located inside the bar at the Yokayo Bowl where he was seated and had ordered a beer. Ramos was taken into custody without further incident. Ramos had discarded a bag during the foot pursuit, which was recovered and found to contain approximately 2 pounds of marijuana and approximately 2 ounces of methamphetamine. Officers seized approximately $2000.00 in US Currency from both suspects pursuant to state asset seizure laws.

Silverman and Ramos were charged with reckless evasion, resisting arrest, possessing and transporting methamphetamine for sale, possessing and transporting marijuana for sale, and criminal conspiracy.

  1. From your descriptions in court and the subjects prior activities detailed is this post, his mental capacity is Meth related and he is more than competent. Can't believe the Doc fell for it.
