Chad Smith's Marsden motion denied, jury trial continued, PD to file amended 995 motion


Chad Smith's Marsden motion to fire his court appointed attorney was denied. Deputy Public Defender Joann Carter, who took over the case last week, will continue to represent Smith.

Chad Smith's case was on today at 9:15 for trial assignment. And again at 11 a.m for a continued Marsden motion hearing. Status of his jury trial and motion to continue rescheduled to 11:30 today.

While the People did not object to the defense motion to continue saying the defense had shown good cause, Deputy District Attorney Stacey Eads did object on behalf of the alleged victims and their families.

Judge Reinholtsen stating there was good cause, granted the defense motion.

Smith's  jury trial  for December 4 was vacated. New date is January 22.

The Dec 5 hearing for a 995 motion was also vacated. Ms. Carter  will file an amended 995 motion next week. Date for that hearing will be set later.

Smith withdrew his time waiver.
