Murder charge against Leigl dismissed, Count 2 not dismissed

The 995 motion to dismiss charges against Nicholas Leigl was scheduled this morning in Courtroom 2.

Count 1, the murder charge and the special allegation was dismissed today.

Count 2 is accessory after the fact with special allegation that "offense was committed for the benefit, at the direction of, an in association with a criminal street gang."Judge Miles based her decision on previous rulings by two magistrates regarding not enough evidence for the murder charge, reading pleadings by both attorneys, hearing oral arguments and reviewing transcripts of court testimony on the case."Two magistrates have rejected the murder charge, based on the evidence," said Judge Miles. "One Superior Court Judge also made a decision on a (previous) 995 motion, that there was not enough evidence for a murder charge.Judge Miles said decisions by the Court cannot be based on conjecture and speculation.Trial confirmation for Leigl is on May 22. Jury trial on June 5. Mr. Michael Acosta is representing Leigl.

Nicholas Leigl jury trial continued to June 5, 995 motion on April 26

Nicholas Leigl, one of four suspects, charged in the homicide case of Jesus Garcia had a jury trial scheduled for April 17.

The jury trial was continued to June 5.
Trial confirmation is on May 24.

A 995 motion to dismiss charges is scheduled for today, April 26, in Courtroom 2.
