DA subpoenas Ashley Pearce-Pifferini's DHHS records and health records from Oakland

Yesterday, there was a hearing on a motion filed by the DA in Ashley Pearce-Pifferini's case. The DA's office subpoenaed records from DHHS & health records from Oakland. The motion was granted. Preliminary hearing still scheduled for 2/6/25.

In my November post, I brought up the possibility of a mental health evaluation.

Nothing had been mentioned in court or by any attorney  at that time.

2/6/25: Defense motion to continue preliminary hearing granted. Defense wants to discuss discovery issues with People related to review of medical documents by expert witness. Setting on 4/10. 

4/10/25: Setting continued by stipulation to 5/9.

5/9/25: 5/9 Preliminary hearing on 9/3 .

9/3/25: Preliminary hearing continued by DA to 9/23 for setting; no objection by defense.

9/23/25: Preliminary scheduled for 1/6/26. 1 day TE

1/6/25: Deputy District Attorney Whitney Timm has filed a motion to continue the preliminary hearing because the people's expert had subpoena in another county and due to courtroom scheduling and availability, there is no guarantee that the preliminary hearing will proceed. Deputy Public Defender Casey Russo wont agree to the expert testifying via Zoom. It is expensive to have the expert so Ms. Timm filed the motion. The motion was granted by Judge Steven Steward. 3/20/26 hearing to confirm real time reports/experts; preliminary hearing on 4/2/26.

3/20/26: Humboldt Superior Court Operations Manager Kelly Nyberg said that if Ms. Timm and Mr. Russo agree she could schedule the 4/2 preliminary hearing in front of Humboldt Superior Court Judge April Van Dyke. Ms. Timm said she will be filing a disqualification for Judge Van Dyke. Further confirmation of preliminary hearing is scheduled for 3/30. Ms. Nyberg told the attorneys, "there are other preliminary hearings ahead of you" and she would have to let them know "whether the case can be assigned."

3/30/26: Preliminary hearing confirmed for 4/2.
