Will Ashley Pearce-Pifferini's case have the same outcome as Ewa Misztal?

Depending on how long you have read my blog, you may remember my extensive coverage of the Ewa Misztal case. I covered that case for years, going to hearing after hearing. The rest of the local media covers a random case here and there, goes for the initial views and then loses interest. Every case is different and meaningful to those involved. 

I cover a lot of court cases. My gut and 10 years of covering Humboldt courts tell me that Ashley Pearce-Pifferini's case which, even without all the details at this initial stage, may end up with similar outcome as Misztal. The Public Defender's office is representing her and I am sure they will have criminal proceedings suspended or a mental health evaluation and pursue other options. This case is tragic. If Pearce-Pifferini has mental health issues, I hope she gets the help she needs. That does not change the fact that a two year old foster child is dead.

Pearce-Pifferini was arrested on November 7 on a Ramey warrant by DA Investigator Ryan Hill.

I have included the complaint, the charges, the court minutes from arraignment on 11/12 and OR bail hearing on 11/14. She has a lot of aliases listed on the complaint but the case name is  Pearce-Pifferini. I have added clarifications to the 11/12 and 11/14 court minutes.

Pearce-Pifferini was arraigned on 11/12, Bail was set at 1 million and the Public Defender's office was appointed. This afternoon, she had an OR bail hearing. She was granted supervised release by Retired Judge John Feeney over Deputy District Attorney Trent Timm's objection. Pearce-Pifferini did not have to post the $1 million bail. Deputy Public Defender Casey Russo made an oral motion to continue the preliminary hearing. Mr. Timm did not waive notice and asked for a written motion so the DA can comply with Marsy's law. Preliminary hearing is still scheduled for 11/22 but that will probably change if defense files a motion. Mr. Russo was Misztal's attorney.

I may do a few posts on this case but that depends on what happens with this case. If it goes through the same process as Misztal, my time is going to be prioritized covering the many cases I am already covering and other news that no one else covers. Some readers are all up in arms now but they will lose interest as they have in many cases. That will definitely happen if this case ends up going through the same process as Misztal.

The minutes list Deputy DA Whitney Timm at the bottom of the page. She is the prosecutor for the case. Mr. Trent Timm appeared on the case since Ms. Timm is currently in trial.

11/14 court minutes:


The way the court minutes are written, it maybe confusing to some readers so I checked with Mr. Timm. Pearce-Pifferini is not waiving the preliminary hearing. Mr. Timm did not waive notice and asked for defense to file a written motion to continue so he can comply with Marsy's law.
