Eureka Police Department Sgt. Dustin Nantz was designated as lead investigating officer for Logan Brewer Hearst's preliminary hearing today in his 2024 criminal case. The hearing did not start until this afternoon. 7 women were in court, 6 with Victim Witness. One was there for Brewer Hearst.
At 3 p.m. EPD Officer Richard Stancliff is testifying. Another EPD officer who was waiting to testify was not called by the People and just left with Stancliffe at 3:15. Sgt. Nantz is testifying at 3:17 p.m. He left at 3:22 p.m.
Ms. Andrea Sullivan is Brewer-Hearst's attorney. Deputy District Attorney Ian Harris is the prosecutor for the preliminary hearing. Judge Steven Steward presided over today's hearing.
When EPD arrested Brewer Hearst, they seized two pistols, two ziploc bags with marijuana weighing "approximately 456 grams and 437 grams, blue pills and 7 bags which they suspected was meth.
This isn't a slam dunk case for trial and Judge Steward went into detail about the definition and standard for a preliminary which he said is very low. Judge Steward also went into detail before ruling on each count. Mr. Harris himself asked Judge Steward not to hold Brewer Hearst to answer for Count 5 because the blue pills were not fentanyl, as EPD suspected. Ms. Sullivan argued that only 3 bags tested positive for meth and that the other 4 bags were not tested by EPD.
Brewer Hearst held to answer to all counts except Count 5. Arraignment on information is on 2/6/24.
Ms. Sullivan asked for a bail review since Brewer Hearst was not held to answer to Count 5. Mr. Harris said he is going to ask for a no bail hold.
Sgt. Nantz was commended by Judge Steward. Had he not testified, I think the ruling might have been different on some counts. I am usually complimentary about EPD but either Officer Richard Stancliff needs more prep to testify because him constantly having to refer to his report for basics and the way testing was done or not done will be an issue at trial.
